BACKGROUND On November 29, 1973, .1ohn H. Stender, Assistant Secretary of
Labor, deferred enforcement by OSHA of that portion of Sec[ion
210-7 of the National Electrical Code, 1971 Edition, with
reference to Ground Fault Circuit Interrupters on construction
si [es. Ground Fault Circuit Interrupters presently approved
are designed to interrupt electrical power if a ground fault
current of 5 milliamperes or greater develops in the circuit
of equipment being supplied by 15 and/or 20 ampere receptacles .
5 milliamperes is too low a value for application at con-
struction sites and this results in "nuisance" tripping of the
electrical power. This part of Section 210-7 of the National
Elec[rical Code has not been enforced as enforcement would
have curtailed 80$ of our construction, therefore should be
deleted from the ordinance until such time as OSHA repeals
their deferment.
The Board of Appeals and Advisors discussed this ordinance
change at their meeting of January 13, 1975•
The Board of Appeals and Advisors on January 13, 1975 passed
Resolution No. 51 approving the amendment to Section 210-7
of the National Electrical Code, 1971 Edition, as adopted
by Chula Vista Ordinance No. 1409•

BACKGROUND At the Council meeting of February 11 , 1975, the ordinance to
amend Section 210-7 of the National Electrical Code, 1971
Edition, as adopted by Chula 4ista Ordinance No. 1409, was
placed on the first reading.
This part of Section 210-7 of the National Electrical Code
has not been enforced as enforcement would have curtailed 80%
of our construction, therefore should be deleted from the
ordinance until such time as OSHA repeals their deferment.

RESOLUTION N0. 51
RESOLUTION OF THE CITY BOARD OF APPEALS AND ADVISORS RECOMMENDING
TO THE CITY COUNCIL THE AMENDMENT OF SECTION 210-7 OF THE NATIONAL
ELECTRICAL CODE, 1971 EDITION, AS ADOPTED BY ORDINANCE N0. 1409
OF THE CITY OF CHULA VISTA, CALIFORNIA.
WHEREAS, Ground Fault Circuit Interrupters are designed to interrupt
electrical power if a ground fault current of 5 milliamperes or greater
develops in a circuit , and
WHEREAS, CAL/OSHA has deferred requiring a Ground Fautt Circuit
Interrupter on construction sites for electrical equipment because of
the low 5 milliamperes, and
WHEREAS, the Board of Appeals and Advisors discussed this matter
at their meeting on Monday, January 13, 1975,
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
l . From facts presented to the Board of Appeals and Advisors,
the Board finds that enforcement of a Ground Fault Lircuit Interrupter
with a tow 5 milliamperes could curtail 80$ of the construction jobs
which would affect public necessity, convenience and general welfare.
2. The Board of Appeals and Advisors recommends to the City
Council that said Amendment to the National Electrical Code, 1971
Edition, as adopted by Chula Vista Ordinance No. 1409, be adopted.
PASSED AND APPROVED BY THE BOARD OF APPEALS AND ADVISORS OF CHULA VISTA,
CALIFORNIA the thirteenth day of January, 1975, by the following vote,
to-wit:
AYES: Ptembers Welsh, Barajas, Johnson, Offerman, Dalseth, Emmons
and Kaya
