BACKGROUND
1 . This recommendation for rezoning is the result of a Council initiated request
in conjunction with a similar rezoning action at 255 E Street. Council was concerned
over the variety of zoning developing in the area and directed the Planning CortYnission
to consider more consistency in the zoning assigned.
2. In the report to the Planning Comnission (attached), staff �found that the existing
uses in the area proposed for rezoning (a bank and 7-Eleven store) were consistent
with the desired C-C zoning, and further, that development of the vacant lot at
265 E Street under the C-C zoning would provide the owner with a wide range of
comnercial uses suitable on E Street, in addition to providing a greater degree of
protection to the residences to the north.

to recorranend that the City Council approve the rezoning of the subject properties from
C-T to C-C, in accordance with the fi�dings and reconmendation set forth in the
attached Resolution PCZ-74-N.

A. BACKGROUtdD �
� 1 . This rezoning is being proposed as the result of Plannin9 Commission
and City Council concern over the variety of zoning ti•ihich is developing on the
north side of E Street, east of Third Avenue. In a recent similar action, the
Council rezoned the property at 255 E Street from C-0 to C-C-P (PC[.-74-L) at the
o�•rner's request. Existing commercial zoning on E Street is nori C-T, C-C and
C-O-P (see locator). In approving the C-C-P zoning, Council found that the C-C
zone is more appropriate than the C-T in protecting neighboring residential land
uses while still permitting a full range of retail commercial activities on
E.Street. The C-T zone is the "heaviest, " most intensive corr�nercial zone, and
allo�rs certain automobile related activities �•ihich could be a nuisance to
adjoining residential uses.
� 2.� An Initial Study ( IS-74-53) of possible adverse environmental impacts
of this rezoning �aas conducted by the Environmental Review Committee on
��ovember 27, 1974. The E.R.C. concluded that there �•iould be no significani
effects and made a P�egative Declaration. P;o appeal of the ND. has been made and
. it will become final on December 12, 1974.
B. ANALYSIS

2. Er.isting Land Uses . •
� The 2t acres proposed for rezoning contain land uses vihich are allo�•red in the
proposed C-C zone. Starting at the corner of Third and E , the breakdoam of land
uses is as follows:

3. Future Land Uses
The existing land uses located on the north side of E Street r•epresent a
substantial investn�ent involvirg compatible uses in harmony with che C-C zone.
. Development of the 0.32 acre vacant lot should also be compatible ���ith the estab-
lished area. The standards set forth in the C-C zone regulations require that
uses be cenducted inside the building, thus providin9 better assurance of
03 protection fo�• the �djoininy residential area from potential nuisance side
� effects im�olving a retail operation.

1 . Good zoning practice and the general welfare of the area necessitates
that the zoning of the subject 2± acres of property at 265-295 E Street
'F recognize not only its location on a busy street, but also the neighboring
residential land uses �•riiich must be insulated from possible adverse ef£ects
from commercial activities permiited by the zoning. Accordingly, the rezoning
of the subject� property from C-T to C-C �•iill still permit retail commercial uses
suitable for location on E Street and convenient to the surrounding area and will
safeguard the existing environment of neighboring residential uses
2. The proposed rezoning to C-C for Retail Commercial is consistent with
the intent of the General Plan.
D. RECOh44EPIDATION
Adopt a motion recorunending that the Council rezone the subject property from
' C-T to� C-C-R in accordance viith Exhibit A.

THE CITY COUP;CIL A CNAi;GE ItJ ZONIPIG FRON C-0 TO C-C fOR
PROPERTY LOCATED AT 265-295 E STREET
�
WHEREAS, on November 12, 1974 the City Council directed that_ an application
be initiated to consider a change of zone for approximately 2 acres at 265-295 E
Street `rom C-7 to C-C, and
WHEREAS, the Planning Commission set the time and place for a hearing on
said application, and notice of said hearing, together o-iith its purpose, was given
by the publication in a ne�•ispaper of general circulation in the City at least
10 days prior to the date of said hearing, and
WHEREAS, a hearing �aas held at said time and place, namely 7:00 p.m. ,
December 11 , 1974 in the Council Chamber, Civic Center, before the Planning
, Commission, and said hearing was thereafter closed.
NOW THEREFORE BE IT RESOLVED AS FOLLOWS: •
• 1 . From facts presented to the Cortunission, the Commission finds that
public necessity, convenience, general welfare and good zoning practice require
the change of zoning from C-T to C-C for 2± acres at 265-295 E Street.
-= 2. The fir,dings of fact in support of said determination are as follo�as:
a. Good zoning practice and the general welfare of the area necessitates
that the zoning of property at 265-295 E Street recognize not only its
location on a busy street, but also the neighboring residential land "
uses which must be insulated from possible adverse effects from
cononercial activities permitted by the zoning. Rezoning the property
, to C-C will permit retail cortunercial uses suitable for location on
E Street and convenient to the surrounding area and will safeguard
the existing environment of neighboring residential uses.
b. R�zoning .to C-C for Retail Commercial is consistent with the intent
of the General Plan.
3. The Planning Comnission recommends to the City Council that said
change be granted.
3 4. That this resolution be tra�nsmitted to the City Council .
