THE CITY COU�;CIL THE CNAtIGE OF ZOIJE FOR 8.88 ACRES LOCATED - ' P70RTH OF E STREET AtJD 5.40 ACRES LOCATED SOUTN OF E STREET, � _ EAST OF I-5, FROht C-V TO C-V-P AND R-3 � 4tHEREAS, the City Council of the City of Chula Vista directed that a study be conducted of the zoning of all areas adjacert to freeway interchanges ' viithin the city, and WHEREAS, pursuant to that study an application was initiated by the � City of Chula Vista for a change of zone from C-V to C-V-P and R-3 for 8.88 acres located north of E Street, east of I-5, and from C-V to C-V-P for 5.40 ' acres located south of E Street, east of I-5, and WHEREAS, the Planning Coimnission set the time and place for a hearing on 1 , said application, and notice of said hearing, together with its purpose, was ' given by the publication in a nerrspaper of 9eneral circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. , August 73, 1975, September 10, 1975 and October 27, 7975, before the Planning � Cortmission, and said hearing was thereafter closed. N04J THEREFORE BE IT RESOLVED AS FOLL047S: 1 . The Cortmission finds that in accordance with the Negative Declaration ._ on IS-75-45, the change of zone wilt not have any significant impact on the ' environment, and certifies that the Negative Declaration was prepared in accord- ance with CEQA, 1970, as amended. • 2. From facts presented to the Comnission, the Cortenission finds that public necessity, convenience, general welfare and good zoning practice require rezoning of properties at the interchange of I-5 and E Street as follows: a. �;ortheast quadrant - 6.08 acres of property from C-V to C-V-P and 1 .36 acres from C-V to R-3; along with 7.44 acres of railroad right-of-way to C-V-P and R-3, as shorm on the attached Exhibit D. • Development of the property zoned C-V-P to be subject to approval of - a precise plan conforming to the folloviing guidelines: (1 ) The location and number of curb cuts shall be minimized to reduce the number of conflicts v�ith traffic along E Street. Access shall be oriented as far east as possible to avoid conflicts � v�ith the interchange. ) 1, � 1 "" • � (2) Should the entire 6.08 acre area not develop at one time, the ' Zoning Administrator shall have the discretian to waive the require- � ment for submittal of a17 or a portion of the skeletat plan for � later phases. Any decision by the Zoning Administrator to vraive � the requirement for a skeletal plan shall be based on the follo�aing ,. factors: (a) Amount of land to be utilized for Phase 2 development in proportion to size of the property. , (b) Suitability of proposed access to the public street for l Phase 7 uses and subsequent phases. � (c) Compatibility of onsite circulation proposed for Phase 1 development with probable development in subsequent phases. � . (d) Compatibility of Phase 7 signing proposals with probable signing needs of subsequent phases. (3) Signs for the property shall be coordinated in design and loca- tion, and shall be reviewed with the objective of orienting their exposure primarily to E Street, thereby minimizing their exposure � to the residential areas to the north. A planned si9ning program � may be undertaken pursuant to Sec. 19.60.490 of Lhe Chula Vista Municipal Code. , (4) Architectural themes o` different uses shall be coordinated. � (5) Lardscaping along E Street shall be coordinated for all uses. (6) Onsite signs and lights shall be properly shielded to minimize the offsite glare into the residential areas to the north. b. Southeast quadrant - 4 parcels, totalling approximately 4.00 acres, � along with the adjoining railroad right-of-xay of 1 .4 acres, from C-V to C-V-P; development subject to approva7 of a precise plan conforming ,_ to the following guidelines: � (1) The landscaping plan accompanying-the redevelopment of any one • or all of the parcels shall reflect its location as one of the gate- ways to Chula Vista. � (2) Redevelopment plans shall be given particular attention with - regard to minimizing the number of curb cuts, locating them as far east as possible, and encouraging joint-usage driveways. (3) A planned signing program for all 4 parcels may be undertaken pursuant to Sec. 19.60.490 of the Chula Vista htunicipal Code. ,l G �J _ , . � �" � ' 3. The findings of fact�in support of said determination are as follows: � � a. Rezoning of 1 .36 acres and the adjacent railroad right-of-way in the � . . northeast quadrent is necessitated by good zoning practice. This portion '' of the property is in use as part of a larger mobile home park, which is zoned R-3. There is ninimal chance that the property will be used � comnercially since the mobile home park is a stable, long term use. A recent parcel map legally separates this parcel from the larger portion _ to the south and reflects the physica7 separation which has existed for - a number of years. � b. The R-3 zoning is in conformance with the General Plan which designates - this area.of the city for multi-family high density and visitor comner- cial use. � c. The amount of acreage of the property located on the north and south sides of E Street, in combination aiith various ownerships and its proximity to the E Street interchange, dictates that the number and , location of access points be controlled. Development of the properties in a coordinated and attractive manner is necessitated by the fact that � E Street is the northernmost gateway to Chula Vista, as specified in the � Scenic Highvrays Element of the General Ptan. The ar?a is larg= �no�gh to contain several complementary visitor comnercial uses. . d. The area to which the "P" Modifying District is applied is adjacent and conLiguous to a zone allowing different larid uses and the develop- ment of a precise plan eiill allo�a the area so designated to coexist between land usages which might otherv�ise prove ircompatible. The property north of this area is residentially zoned and developed. l•lith ,. future development of the subject property �nto coirenercial uses, it is necessary to carefully buffer the residential areas from the cortenercial , uses, particularly the external effects of signs and lighting. e. The area to which the "P" htodifying District is applied consists . of tvro or more properties under separate ownership Yiherein coordination regarding access, onsite circulation, site planning, building design and ' identification is necessary to enhance the public convenience, health, , safety and general welfare: (1 ) Northeast quadrant - Although the site is nov� in one ownership, its size indicates two or more uses could easily be acco�dated. It is essential that all proposed uses be added to the site in 1 6�� _ r , � .; . . , . � . . _ accordance with an approved precise plan, with particular regard to coordinated access, architectural theme, landscaping, � and signing. (2) Southeast quadrant - This area is under four separate � ownerships and therefore it is important that development or redevelopment of the area be in accordance with an approved . � precise plan, with particular regard to coordinated access, architectural theme, landscaping ard signing. 4. The Ptanning Comnission recomnends to the City Council that said changes of zone be approved. 1 5. That this resolution be transmitted to the City Counci7.
