This item was continued from the meetings of November 25, 1975 and December 16, 1975 to permit a readvertising of the proposed City initiated rezonings, since two Councilmen had not been present to hear the testimony offered at the November 25, 1975 meeting. 2. The A-113 report and attachements thereto, dated November 25, 1975, are enclosed. 3. For the Council !s information, the two duplex lots located at the northwest corner of H Street and Colorado Avenue were rezoned from C-V to C-V-P on October 14, 1975 (second reading and adoption) Ordinance No. 1651 . Sumnary This is a proposal to rezone four parcels totalling 2.09 acres from C-V to C-V-P at the I-5/H Street interchange. The parcels were added to the I-5 rezoning program by the Planning Coirnnission which determined that even though the properties are developed with service stations, the "P" zone was appropriate due to the location at a gateway to the City. 2., Discussion a. Surrounding zoning and land use: North - R-3 Duplexes South -. R-3, G-T Mobile Home Park, apartments East - G-T Service station Vlest - C-V Railroad, Freeway I-5 b. The four parcels under study are fully developed with service stations; all are apparently stable, long term users at the interchange. Three of the four stations are owned by major oil companies. The primary concern of the Planning Cormnission was that these properties, in the C-V zone, make up the gateway to the City at H Street and that the precise plan control should be present in the event any one or all of the subject parcels are redeveloped. Therefore, the precise plan aoplication to these parcels would deal with landscaping and signing of future redevelopment in keeping �aith their prominent location at this gateway. An Initial Study, IS-75-67, of possible adverse environmental impact of this project, PCZ-75-I, was conducted by the Environmental Review Cortmittee on October 2, 1975. PCZ-75-I n -� ,u RESOLUTI01� OF THE CITY PLANNIN6 COiL`tISSIOH RECOi•u�tENDING TO THE CITY COUNCIL THE CHAt�GE Of ZOPlE FOR FOUR PARCELS LOCATED ADJACENT TO H STREET, EAST OF I-5, FROI•1 C-V TO C-V-P , WHEREAS, the City Council of the City of Chula Vista directed that a study be conducted of the zoning of all areas adjacent to freeway interchanges . within the city, and WHEREAS, pursuant to that study an application was initiated by the City of Chula Vista for a change of zone from C-V to C-V-P for 2.09 acres, � comprising 4 parcels 7ocated at 695, 717, 720 and 730 H Street, and WHEREAS, the P7anning Cortmission set the time and place for a hearing on said application, and notice of said hearirg, together with its purpose, was . given by the publication in a nevispaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. , October 27, 7975, before the Planning Cortenission, and said hearing was there- after closed. � - N041 THEREFORE BE IT RESOLVED AS FOLLOWS: 1 . The Cortmission finds that in accordance with the t;egative Declaration on IS-75-67, the change of 'zone witl not have any significant impact on the _. environment, and certifies that the Negatibe Declaration was prepared in actordance with CEQA, 1970, as amended. 2. From facts presented to the Comnission, the Comnission finds that public necessity, convenience, general welfare and good zoning practice require the change of zone from C-V to C-V-P for four parcels located at 695, 717, 720, and 730 H Street (shown on Exhibit A, attached), erith additions to existing developments, or redevelopment of the properties to be subject to an approved precise plan conforming to the folloriing guidelines: a. Landscaping shall reflect the location of these properties as one , of the designated qateways to the City. b. Future signing shall be oriented to H Street and be in keeping ' with the policies of the Scenic Highways Element. ' 3. The findings of fact in support of said determination are as follorrs: a. The subject properties, or area in which the properties are located is designated as a gafeway to Chula Vista in the Scenic Highriays Element �� of the General Plan. All four parcels front directly on H Street and constitute the focal point of the entrance to the City at this location. � _ . . . . . b. Although the present uses appear stable, if any one or all of the parcels are redeveloped, special consideration should be given to the , landscaping and signing treatment of such new development. 4. The Planning Commission recomnends to the City Council that said change of zone be approved. 5. The imposition of the precise plan requirements to the properties near th�se interchanges constitutes a higher level of regulation than is currently carried out in the consideration of developnent plans. This hi�her level of regulation Nlll insure that the long term protection and e;hancerent of tlie environment is maintained and the possibility of substantia] adverse iripacts due to development of these properties is avoided. . b. This zone change. is designed to imp',e�ent long term goals of tiie City of Chula Vista �nd rrill not therefore attain short term to the disadvantage of long term goals. • , C. The imoacts from this zone change, are so insignificant to preclude any eumulativel� ;ignificant jm pacts. There are no groVrth inducing effects due to 2he pro�ect. � d. The imposition of these development reculations �iill insure less adverse . effects on human beings due to the development of these properties. NOTE: These findings apply only to the reioning action of the City of Chula . Vista and not to the review of any precise plan on the redevelopment of this property.
