' ITED1 TITL"c: Ordinance - Rezoning that Certain'Property� Located ,in the Bayfront , , _ _ Area from I to P-C, R-3-H-P and.C-V-P� - INITIATED 'nY: �City Attorney . - - • BACKGROUND � ' The City Attorney requests that the ordinance adopted on second reading on January 22', 1974 relative to the Beyfront• rezoning be placed on first reading _ - and reenacted as amended: • The"P}anning Comnission during their hearings had recommended the inclusion of certain Tidelands areas in the rezoning proposal for the .entire Bayfront area. As Council 'is aware, the •Tidelands, pursuant to the San Diego Unified Port District . Act, _can.,be zoned tiy the several municipalities composing the, 5an Diego Un.ified. Port District to and until April 5, 1962. Prior to that date, the City of Chula Vista adopted a T zone or Tidelands zone into which all of said property under the jurisdiction of the City of Chula Vista was incorporated. The City may not by law � ,- amend"or alter that zoning as it existed pribr to Apri1 ;5, 1962. : � The Deputy City Attorney, who was at the Planning .Corrmission meeting, was not aware of- that provision. It does not appear, however, even if the City could .legally ' � attach the p,recise plan. requirement to. the Tidelands•area that any significant change in the City' s zoning control span would be affected. The iidelands zone itself is not a typical zoning device. It simply authorizes those uses' which _are authorized by the Tidelands _trust. It is recognized that - nothing more, or less in the way of uses could'be authorized. The Tidelands zone does provide' that any development of such uses must be reviewed by the Planning Commission and -the City 'Councii ' of the City of Chula Vista. Page Two . • _ r In the past 12 years, the City has only reviewed development plans on a limited number of occasions. This office recalls only a wash room and some warehouses. In light of this fiisEory� to' give `insurance to the Port Cortmission that the Lity wishes to continue its excellent relationship with the Comnission and adhere closely to both the State law and our own local ordinances, it is recomnended [hat the ordinance be appropri- ately amended. An amendment of this nature does not require that the matter be referred back to the Planning Commission for a report nor is it necessary to reopen the public hearing. The attached ordinance is available to be acted upon first reading at the present time. .��
