at its meeting of November 19, 1974 and is, therefore, back this week for
second reading and adoption.

ITEDITITLE: Ordinance - Repealing Section 23. 24 of the Chula Vista City
Code relating to the Uniform Plumbing Code, which has been Superseded
and should not be Codified in the 1974 Chula Vista City Code

BACKGROUND
The attached ordinance has been prepared to assist Book Publishing
Company in the recodification of our City Code. The proposed
ordinance is strictly a housekeeping measure in that Section 23. 24
of our City Code, relating to the Uniform Plumbing Code, has been
superseded and, therefore, should not be codified.

Dear Jim:
On February 2, 1978, I wrote to you that the City Council had
, reluctantly passed Ordinance No. 1780 to prohibit the moving of
buildings within or into the City of Chula Vista . This was
brought on because of the passage of Senate Bill 1072 which, by
our interpretation, prevented us from requiring as a condition
of the move any improvement , even to bring the building up to
present building, electrical and plumbing code standards.
On September 8, 1978, City staff sent a letter to r1r. Xavier
riendoza, Chief , Department of Housing and Community Development ,
outlining the minimum health and safety requirements that the
City has imposed on moved buildings and questioning as to why we
could not continue to require minimum standards of health and
safety.

In answer to this inquiry, Mr. Mendoza, in essence , said the
City could continue to impose , as a condition of moving buildings
within or into the City, improvements to bring the buildings up
to code.
Therefore, we wish to withdraw our request that SB 1072 be amended
and offer our thanks for your continued support of the needs of
our City.
