After holding a public hearing on August 20 , 1974 for
consideration of this zone change , the ordinance was placed
on first reading. It is now before the Council to be
placed on second reading and adopted.

A• BACKGROUND
1 . This item was continued from the meeting of August 13, 1974 to allow the applicant
and the staff time to assess the impact on the development of the requirement for a
zoning wall separating the R-1 and R-3 properties. At the August 13 meeting, staff
indicated that a 6 ft. masonry wall would be required.
This assertion was incorrect. A more careful reading of Sec. 33,901 B (36) requires
a masonry wall only between comnercial and residential development. A 6 ft. high solid
fence is required to separate multiple family zones from single family zones .
2. Request
The church is requesting that a portion of their property be rezoned from R-1 to R-3,
for the primary purpose of allowing a preschool operation in an existing building,
which is allowed by conditional use permit in the R-3 zone but is not allowed in
the R-1 zone. The locator map shows the property near the corner of Fourth and D
Streets.
That portion of the site on which the sanctuary is located is zoned R-3 and has been
for many years. That portion of the property presently zoned R-1 is presently
occupied with parking, an educational building, and a parsonage.

2. Site characteristics.
The parcel proposed for rezoning is owned by the First Assembly of God and con-
tains the follo�ving land uses:
a. Parsonage facing D Street
b, Parking for the church
c. Garage used for storage
d. Educational building, previously used for housing for the assistant pastor.
3. Proposal .
The 2100 sq. ft. building shown on Exhibit A is proposed for use to instruct 60
preschoolers in a day nursery. Such use is not permitted in the R-1 zone. It is
allowed by conditional use permit in the R-3 zone. A conditional use permit
application for this use has been approved by the Planninq Commission contingent
upon favorable Council action on the rezoning.
4. Precise Plan.
The subject rezoning request for R-3 would theoretically allo�a any use permitted
by the R-3 zone. Since the intent of the request is to authorize the operation
of a preschool only, it would be appropriate to rezone the parcel to R-3-G-P with
development subject to an approved precise plan for the church and its related
activities. The density allowed in the R-3-G zone conforms with the General Plan
but the higher density allowed in the R-3 zone does not conform.
D. fINDINGS
1 . Good zoning practice indicates that the R-3-G-P zoning, subject to
conditions, would produce a more logical zoning boundary coincident with ownership
lines and would be compati6le with adjacent R-1 areas since the basic use of the
property would remain the same.
2. The General Plan designation for this area is split between medium density
residential (4-12 dwelling units per acrej and high density residential (13-26
dwelling units per acre).. Thus a rezoning to R-3-G�P conforms to the General Plan.
