BACKGROUND
The Regional Water Quality Control Board, in response to a study
conducted by the � Department of Water Resources, has advised the
County and cities within the County of the need to adopt acceptable
standards for the construction of water wells and cathodic protection
wells. The action to date has been on an informal basis so as to permit
the various agencies sufficient time to develop and adopt standards
acceptable to the State.
Following receipt of the informal notice this agency joined with other
agencies in requesting that the County of San Diego develop model
standards appropriate for use by all area agencies.
The County staff, in conjunction with a committee of area and industry
representatives ,. has developed a "model" ordinance which has been
reviewed and preliminarily judged to be adequate by the Regional Water
Quality Control Board staff. The ordinance will be considered by the
Board itself on September 16. The Board is also expected at that
time to establish a date for a puhlic hearing (probably in October
or November) at which time they. would find a need for establishment
of standards by the various municipalities which have not meanwhile
adopted such standards. Once notified, each agency would have a maximum
of 120 days in which to adopt appropriate standards. The Board is
empowered to adopt standards in behalf of any agency which fails to
take appropriate action during the 120 day:-,period.

to be retained by the County as payment for services rendered.

The proposed ordinance is for all purposes a duplicate to that
adopted by the County. Its� primary features include:
1. Sets out standards for construction, repair or destruction
of water wells and cathodic protection wells.
2. Authorizes tlze County Health Officer to issue permits, hold
bonds, abate nuisances and otherwise enforce the provisions
of the ordinance. (Note: Permit fees and estension of permit
fees , collected by the County Health offices are to be re-
tained by the County as payment for services rendered. )
3. Establishes method of appeal to City Council relative �to
order of abatement.
4. Establishes method of payment of cost of abatement.
5. Establishes method of appeal to City Council relative to
denial or conditions of a permit.
This ordinance is somewhat unique in that it will be enforced by the
County Department of Public Health. However, such practice is in
accord with the Basic Health Agreement (Res. 1389) between the City
and the County which provides for County enforcement of health-
related regulations when the City regulations and penal provisions
are identical to those set forth in the County ordinance.
