[ 21 ] CHULA VISTA CITY COU\CIL DfEETING OF: April 2, 1974 ITEDITITLE: prdinance - Amending Section 27 . 303 of Article 3 of Chapter 27 of the Chula Vista City Code Relating to Those Encroach- ments in the Public Right of Way Exempt from Fee Requirements INITIATED BY: Director of Public Works/City Engineer� BACKGROUND The City Code requires payment of fees and issuance of an Encroachment Permit for all encroachments into the public right of way. Certain encroachments, namely sprinkler systems and pole-mounted mail boxes, frequently result from conditions over which the property owner has no control (such as landscaping required as a condition of approval by the Planning Commission) . Such encroachments do not necessitate the detailed plan review commonly required. In view of the minimal staff time involved and the typically unique circumstances involved, it is recommended that the specified encroach- ments be exempted from Encroachment Permit fee requirements . The proposed amendment to the City Code exempts encroachments in the public right of way for the installation of sprinkling systems and mail boxes from the payment of permit fees . However, such installa- , tions shall continue to be subject to the execution of an Encroachment Maintenance and Removal Agreement.
