BACKGROUND l . Request ' _-. The applicant, Par Construction Co. , is proposing to construct 136 single fanily homes on 108± acres of property. Of the total , 76 acres are proposed for annexation. The remaining 32 acres, already in the City, are presently " zoned R=E. The'R=E-P zoning is being requested so the applicant may reduce the lot sizes belo�•r the 20,000 sq. ft. minimum while still remaining �iithin the overall _density permitted-.by the R-E zone. ,- An ad'ditional 2.4 acres± of Property, loceted south of Otay Lakes Road in , the County, _ is also proposed for prezoning to R=E-P. This parcel is not . oivned.by the applicant; however, the other. property owner is aware of the proposal . _ . 2. Annexation. . _ � LAFCO requires prezoning as a prerequisite for approval of an annexation: The annexation of the 78.4± 'acres �•�as approved by the Planning Cormnission on December 12, 1973 and includes the 2.4± acres soutli of Otay Lakes Road not. in the applicant's ownership. Environmental Impact'Report The Environr�ental Impact Report EIR-73-17 for Bonita Ridge Estates was adopted by the Planning Commission on December 12, 1973. 6. ANACYSIS 1 . Surrounding zoning, land use, and jurisdiction: North - A-4(1 ) - Vacant - County Soutli - R-E, R-1-10-P Vacant - City (Proposed Ranchito Robinhood) East - E-1 ; R-1 - Residential on Acacia and Palm Drive - County !•lest - R-E - Residential - City 2. As previously noted, the .purpose of the R-E-P zoning is to utilize the provision of the "P" Precise P.lan 1�1odifying District to enable the developer to create lots less than the 20,000 sq, ft. minimum required by the R-E zone. The tentative map, no�a being reviewed by staff, contemplates the creation of 136 single family lots on the site. The smallest lot is 7600 sq. ft. ; the average lot size is 10,600 sq, ft. The density of the development is 1 ,3 dwelling units/acre, toward the loei end of the General Plan range of 1-3 DU/acre and 4-12 DU/acre. The primary reason that smaller lot sizes are being proposed is to group_ the lots on the more developable parts of the site, and leave the steeper slopes undeveloped. Approximately 50% of the site will be ungraded and undeveloped, 3. The Qonita Ridge Estates development is coordinated closely with the proposed subdivision to the south--Ranchito Robinhood--which also has utilized tfie "P" Modifying District to allow smaller lot sizes than would normally 6e allowed, The Ranchito Robinhood tentative map �aas approved by the City Council on I�ovember 27, 1973. As in Ranchito Robin600d, staff finds the building sites proposed in Bonita Ridge Estates to 6e adequate, and the addition of the "P" zone, �•ihile providing flexibilitq to the developer, a�ill also provide the City a greater degree of control over the development standards. C. ' FIIlDINGS 1 . The applicant is attempting to minimize the grading, and has significantly reduced the number of units on his property in an effort to conform with the concept of the Hillside Modifying District even though the district regulations do not apply to the property. � 2. The General Plan shows "low (1-3/acre) and inedium (4-12/acre) density residential . From facts presented to the Comroissior., the Car�u�ission finds that public necessity, convenience, general �velfare and good zcnin9 practice require the change of zoning and prezoning from R-E to R-E-P for 2pproximately ii0 acres; as sho�•m on attached exhibit, and based on the folloviing: a. The approved Precise Plan includes specit=ic floor plans ane+ ' elevations, and allo�as for a maximum of 13�6 �+�+elling units located on the north side of Otay Lakes Road. b. .The specific number of units is predicatud upon the approval of final subdivision maps recorded for each ur�it, 2. The findings of fact in support of said deter:�ination are as foliot��s: a. Attachment of the "P" h1odifying District rrill permit a develop- ment plan which minimizes the grading and redaces the number of units normally expected in the R-E zone. b. The pr000sed zone change con`orms to the low end of the Ger.eral Plan Range (1 - 3 units per acre). / � - � 5� 3.
