ITEDITITLE: Ordinance - Amending Section 10 . 101 of the City Code
relating to the keeping of hawks and falcons - Second Reading

BACKGROUND
Some time ago, a citizen appeared before the City Council requesting
permission to keep a hawk in order to engage in the practice of
falconry.
It should be noted that birds of prey are ferae naturae and are,
£herefore, prohibited by the Chula Vista City Code. However,
Council directed that an appropriate amendment be prepared to
authorize this .
The Attorney General has recently set forth an opinion, which now
allows licensed falconers to acquire a qualified ownership for the
practice of falconry, provided, that such person comply with the
rules and regulations of the Fish and Game Commission. Said rules
and regulations limit the number of birds and provide substanti:al
restrictions as to their keeping. Based upon this Attorney Genera3 ' s
opinion, an appropriate amendment to the animal regulations has been
prepared.
In addition, the City Attorney' s office from time to time receives
inquiries as to the keeping of certain animals such as goats by
school children for educational purposes . It is felt that the total
prohibition presently contained in the ordinance unjustifiably denies
children the opportunity to acquire knowledge as to the nature and
character of such animals . Therefore, a second provision has been added
to allow the keeping of such animals for bona fide educational purposes .
