ITE�1 TITLE: Ordindnce No.__1512 -�Amending Chapter 33 of the City Code_ establishing
• "H" Hillside Dlodifying District - Second reading and adoption

p, BACKGROUND
After taking public testimony on PJovember 20, 1973 the City Council closed the public
hearing, and after discussion moved to take the following actions:
l . Adopt the Hillside Development Policy, Resolution No. 7088.
2. Directed staff to prepare an amendment to the "H" Hillside District ordinance,
with the following changes:
a. Delete the "R-E': zone category from the nomograph.
b. Chan9e the wordin9 of Section 33.701 A (7) (bottom of page 2 of Resolution
PCA-73-3) to allow density credit for area required to be dedicated to the
City under the Park Land Dedication Ordinance.
c. Add the following wording to the footnote to Column 2 of the nomograph:
"Areas graded in order to accommodate common recreation facilities may be
counted as ' ungraded areas ' upon approval of the City Council . "
d. Add a section providing for termination of the ordinance two years following
the date of its adoption.
e. Delete that portion of the Hillside Development Policy pertaining to signs
(page 4, para9raph 9c) .
f. Refer to the Planning Commission the matter of rezoning and prezoning
suitable areas to the "H" District.
B. ANALYSIS
l . The changes requested by Council have been made except for incorporation of
an automatic termination date into the ordinance; updated versions of both the "H"
Hillside Modifying District and the Hillside Development Policy are enclosed for
the Council ' s review. As indicated in the City Attorney's memo automatic termination

Financial Statement:
Commission-Board Recommendation: The Planning Commission recortunended by a 5-1 vote
that the City Council adopt the amendment to the Zoning Ordinance establishing the
�H �� Hillside Modifying District.

of the ordinance is not legally possible but Council can announce an intent to
review the ordinance after a period of two years.
2. The matter of rezoning properties to the "H" Modifying District has been
referred to the Planning Cormnission for report and reco�nendation.
