HomeMy WebLinkAboutReso 1963-3041 • RESOLUTION No. 3041 GRANTING VARIANCE IN SEWER SERVICE FEE CHARGES FOR ROHR CORP. AS RECOMMENDED BY THE CHIEF ADMINISTRATIVE OFFICER WHEREAS, the City Council did adopt certain Rules of Interpretation and Procedure for Administration of Requests for Variance from Sewer Service charges, authorizing the Chief Administrative Officer to make recommendations to the City Council for adjustments and variances in fees to be collexted, and 1. WHEREAS, the hereinafter described properties generate sewage which is substantially different in volume from the average sewage entering the sewer system of the City, and 2. WHEREAS, said hereinafter described properties are used for industrial purposes of such nature that the water supplied to such premises is not entirely or substantially discharged into the sewer system of the City, and 3. WHEREAS, the water is furnished to such premises by the California Water and Telephone Company 4. WHEREAS, property having the unique characteristics hereinabove enumerated is a class of property subject to adjustment and variance by recommendation of the Chief Administrative Officer NOW THEREFORE, BE IT RESOLVED as follows: The Council of the City of Chula Vista finds that the properties of the Rohr Corporation being situated West of the Walnut Street trunk Sewer and served by water meters bearing account numbers 53-927 456 and 53-927-077 are properties subject to variance under the provisions of Section 26.82(a) 1 and 2 of the City Code 2. The Chief Administrative Officer has recommended that a flexible variance rate be established in accordance with the conclusion and recommenda- tion of the attached Investigator's Report marked "Exhibit A" and included herein by this reference hereto as though set forth in full herein. 3. The recommendation of the Chief Administrative Officer is hereby approved, ratified and adopted., subject to modification upon ten days written notice to applicant or occupant in possession of said premises. DATED: City Clerk A ROHR CORPORATION INVESTIGATOR*S REPORT The "Rules of Interpretation" adopted concurrently with Ordinance 807 provide for only one method of determining a variance rate other than the 30% rate set forth in said ordinance. All calculations were based upon the best information available. Such information is necessarily limited in scope because certain records have just recently been initiated. However, it is felt that the compu- tations herein are valid within the limitations of equality inherent to the ordinance. (F) - ' (4t of_ Water From the current rate structure of the California Water and Telephone Company the cost of 3,010,400 cubic feet of water is found to be $6,841.28. 'U) Sew r_ Service Charge, The variance rate times the cost of water used is equal to the sewer service charge 13.5% x 6841.28 = $923.57 CONCLUSION AND REcommENQ. fM It is recommended that monthly readings be made by the City per- sonnel to determine actual sewage flow initiated in the Rohr yards west of the Coronado Branch of the San Diego Arizona and Eastern Railway. Knowing both the sewage flow and water usage, the formula es- tablished in the "Rules of Interpretation" can be applied to deter- mine a variance rate and total charge. In view of the lack of sew- age flow records in this case, it is recommended that a fixed rate not be established at this time for the Rohr Corporation. Direct billing by the City is indicated as the most practical means avail- able in view of the complexity of the calculations involved. It is therefore, suggested that the required resolution es- tablish the means by which the charge will be determined on a monthly basis and thus permit a flexible rate more directly in proportion to the actual sewage flow. -2-
