[ 1.� ) CHULA VISTA CITY COUNCIL �tEETING OF: . � SEPTEM1I6ER 4, 1973 ITEM TITLE: �Tdinance No. 1498 - �ending Section 6 . 302 and 5 . 206 Relating to License Requirements for Auctioneers and Requirements for Conduct o£ Auctions - Second reading and ado-p tion INITIATED BY: City Attorney BACKGROUND In April of this year, Council reviewed a proposed ordinance change in our licensing requirement for auctioneers, eliminating the residency requirement. At that time, the question was raised as to the amount and purpose of the bond requirement and the proper reimbursement of any on-duty police officers attending such auctions . Modifications to the appropriate sections have been made, first of all eliminating the discretion of the City Attorney in setting the bond amount. Said bond amount is established in Section 5 . 207 of the City Code at $5, 000 . The purpose of the posting of the bond is to insure reimbursement to persons who may be defrauded or otherwise damaged because of unscrupulous activities of the auctioneers . The bond would allow such persons who are aggrieved to sue in their own name and be reimbursed from the bond amount. The second area of inquiry concerning the proper reimbursement to the City has been undertaken by amendment to Section 5 . 206, subsection 3, which requires reimbursement in the equal amount of the police officers daily salary . This ordinance was placed on first reading on August 28, 1973.
