The bill deletes sections of the Code requiring that annexation costs be "paid by the city annexing or attempting to annex territory," and adds Section 35016 which requires the city to pay annexation costs only if there is no agreement between the annexing city and the proponents of the annexation concerning payment of fees. Presently, the only method of ensuring payment by the proponents of an annexation is through the provisions contained in LAFCO's City Annexation Questionnaire. Section V, page 3 of the questionnaire affords the city an opportunity to attach terms and conditions to proposed annexations. LAFCO, in a letter dated April 4, 1973 suggests that cities utilize this section as a means of requiring proponents to pay the State mandated fees associated with annexations. The City Council can eliminate the possibility of the City being held liable for payment of State mandated fees, while at the same time collecting fees to cover processing, by adopting an ordinance requiring that the proponents of an annexation submit a cash deposit, equal to the amount of all required fees, prior to the processing of a request for annexation.
