CHULA VISTA CITY COU\CIL tEETI\G OF: May 15 , 1973
ITEITITLE: Ordinance - Amending Chapter 2 , Article IX, Section 2 . 91 of
the City Code Relating to the Requirements for the Number of
Votes to Pass upon any Recommendations
I\ITIATED BY: City Attorney
BACKGROUND
The Charter requires , in reference to any board or commission, that
a vote of the majority of the entire membership is necessary to take
any action.
In establishing the Board of Appeals some years ago pursuant to the
provisions of the Uniform Building Code of the State, the ordinance
was drafted in such a way as to permit the transaction of business
by a majority of the members present. Some Board members have
questioned this provision and although it has been pointed out
that the Charter overrides any such provision in the ordinance,
it seems desirable to make the change in the ordinance as a house-
keeping measure so that thae will be .no confusion as to the require-
ments for taking action on recommendations .
Therefore, an ordinance has been introduced simply to require that
a majority of the total membership of the Board would be necessary
to pass upon recommendations. It should be noted that this means
not simply the current complement, but 4 members out of 7 total
members .
