[ s ) CHULA VISTA CITY COU\CIL �IEETIa\'G OF: MARCH 20 , 1973 ITE�i 'rITLE: Ordinance - Amending Chapter 29 , Article 2 of The Chula Vista City Code Relating to Land Grading , Excavations and Fills I\ITIATED B1': Director of Public Works/City Engineer � BACKGROUND �° The Planning and Public Works Departments have cooperated in making revisions to Ordinance 1163 , which deals with land grading , excavations , and fills . The changes mainly relate to : ( 1 ) slope configurations and landscaping ; and ( 2 ) minimum requirements for obtaining a permit . The landscaping requirements associated with the grading of a site will now be in conformance with the City ' s landscape manual . The revisions are summarized below : l . Adds a definition for "Landscape Manual . " 2 . Changes the definition of "Property Owner" to include sub- divider or developer of real_ property which will be benefited by the proposed work . � 3. Adds a definition for "Subdivider . " 4 . Establishes time limitation in which to perform the work . Also stipulates that a time extension shall not exceed the original length of time for performance of the work as designated on the permit . ' .. ` -+ _ � .. ?: Supplemental Pag�e 2 � � 5 . Modifies slope requirements as follows : (a ) Uncontrolled embankment fill slopes shall not be steeper than 3 to 1 . Embankment shall be situated and/or graded in such manner as to prevent erosion of the embanked material . No ponding of water shall be permitted . ( b ) All slopes .in excess of 6 feet shall be .planted and irrigated in accordance with the landscape manual . Landscaping shall be maintained by the permittee for the first 90 days and shall be guaranteed for a period of one year. (c ) Cut and fill slopes are to be modified by blending the slopes into existing terrain the produce a natural appearing transition ; rounding the tops and toes of the slopes ; varying the slope ratio to create an esthetically pleasing appearance ; and rounding the intersection of slopes to obtain a more natural appearance . 6 . Changes bonding requirements to include landscaping . 7 . Changes regulations governing grading work which may be per- formed without obtaining a _permit . It will now be possible to grade up to 250 cubic yards instead of the prior limit of 100 cubic yards of earth without permit as long as c,ertain conditions are met , i . e . no adverse effect upon existing drainage patterns , slopes are not steeper than 3 to 1 , none of the slopes exceed three ( 3 ) feet in vertical depth or have an average depth. in excess of 1z feet . �_ : . �. , (These regulations have been relaxed so as to exempt the bulk of minor grading projects from the �unwarranted expense of obtaining a per- mit . Additionally , they reduce staff time requirements to process permits of minor significance . ) 8. Adds requirement that applicant provide a landscape and irri - gation plan indicating the planting density , type and location , and the layout of the irrigation system. 9 . Designates that a special investigation fee will be charged for all requests for time extensions or variance requests . 10 . Specifies that the cost estimate used in determining the fees to be paid by the� applicant will now also include the cost of irrigation facilities . The recommended chan9es are based upon experience accumulated during four years of administering the current grading ordinance . The pro- posed modifications will : 1 . Simplify administration of the ordinance . 2 . Clarify the application of the ordinance . 3 . Provide manufactured slopes which are more esthetically pleasing . 4 . Provide for stricter and more practical landscapin9 of slopes . / J ��� 1 '
