II�'CLUDING SETTING THE FEE AT$40 FOR FISCAL YEAR 201� V�'IIEREAS, Califomia State Mobilehome Residency Law� allows local jurisdictions to esiablish rent controL' and A'HEREAS, in 1982, the City adopted Chula Vista Municipal Code Chapter 9.�0, "Mobilehome Pazk Space — Rent Revie�v," as allo���ed b}� Mobilehome Residency La��, and amended it to its current state on Jul�� 19. 2011: and WHEREAS, these amendments took effect August 18, 2011, and established an administrative fee to provide a limited seament of the public, specificall}� mobilehome residenu, per 9.�0.030, the ability to obtain unique ser��ices and benefits available only to them under Chapter 9.�0, includine, but not limited to, a rent calculation (via the annual permissive and exceedine the annual permissive) H�hich results in reduced rents and related ombudsman services: and WHEREAS, on February 14, 2012, the City adopted "Mobilehome Park Space - Rent Revie�ti Administrati��e Fee Regulations` establishine a process for determinina and collectine such fee: and WHEREAS, the proposed fee does not esceed the estimated reasonable cost of pro��iding the associated services and the fund balance of the fee and estimated revenues for Fiscal Yeaz 201� aze sufficient to ���arrant a decrease in the fee rate for the comine year; and ' VJHEREAS, Article J{III C of the Califomia Constitution requires a vote of the electorate to increase any 1evy, chazge; or exaction imposed by a local govemment, unless specifically e�empted: and WHEREAS, pursuant to the provisions of Article XII C, the proposed fees aze exempt from the vote requirement; and �i'HEREAS; the proposed amendment to the Master Fee Schedule Chapter 18 (Mobilehomes) shall become effecti��e upon adoption of this Resolution by the City Council. 1�'OW. THEREFORE. BE IT RESOLVED that the Citv Counci] of the Citv of Chula Vista does hereby amend Chapter 18 (Mobilehomes) of the Cin�`s Master Fee Schedule as reflected on Exhibit 1 to this Resolution and sets the fee as �40 for Fiscal Yeaz 201�.
