BACKGROUND
The subject property includes approximately 2.2 acres of vacant land located within
the Civic Center Design Control District. The purpose of this application is to
bring the property's zoning into conformance with-.the General Plan.
A public hearing was held on this matter at the meeting of February 6, 1973, and
this ordinance was placed on first reading at that time

IdHEREAS, the City Planning Commission determined the necessity of
considering a change of zone for approximately 2.2 acres located at the
southeast corner of Fourth Avenue and Center Street in order that the zone
designatio� and Chula Vista General Plan �•�ould be in conformance, and
IJHEREAS, the Planning Conunission set the time and place for a hearing on
said rezoning, and notice of said hearing , together �•�ith its purpose of considering
rezoning said property from R-3-D to C-O-D, �•tas given by the publication in a
ne�•ispaper of general circulation in the City at least ten days prior to the date
of said hearing, and
l•lHEREAS, a hearing �•ras held at said time and place, namely 7:00 p.m. ,
January 8, 1973, in the Council Chamber, Civic Center, before the Planning Commis-
sion and said hearing was thereafter closed.
N04! THEREFORE BE IT RESOLI�ED AS FOLL041S:
1 . From facts presented to the Comnission, the Co�mnission finds that public
necessity, convenience, general welfare and good zoning practice require the
change of zone for 2.2 acres located at the southeast corner of Fourth Avenue
and Center Street from R-3-D to C-O-D and a change in the front yard setback adjacent
to Fourth Avenue from 15 feet to 10 feet.
2. The findings of fact in support of said determination are as follotas:
a. The General Plan designates this area in the professional and
administrative office category.
b. The C-0 zoning is compatible with the zoning and land use along
Fourth Avenue in the vicinity of this property.
c. The 10 foot setback riould _be consistent �•�ith the setback permitted
in the C-0 zone and the setback granted in similar cases in the vicinity
of this property.
3. The Planning Conunission recommends to the City Council that said
reclassification be granted.
4. That this resolution be transmitted to the City Council . �
