CHULA VISTA CITI' COUNCIL DfEETING OF: `Decemberc 12„ 1972 2 ITEM TITLE: Ordin'ance��1431 - Prohibiting the Resale of Cable Television Services at a Rate More Than or Differing from the Rate Established by the City Council Pursuant to the Terms and Conditions of the Franchise Ordinance - Se�nd� readfrigi�and adoption INITIATED BY: City Attorney BACKGROUP 7 D: One of the major problems which has prompted the cable television franchisees in all other communities except for Chula Vista to demand payments of single family rates for multiple family dwellings, has been what can only be termed a "pirating" activity on the part of owners, manager or other individuals interested in the operation, to purchase a single outlet of cable service in an apartment complex at the rate of $5. 50 and then to wire the entire apartment building to serve the tenants therein at rates ranging from $3-6 per unit. The cable television company feels strongly that they are being poorly used in such a scheme. Therefore, an ordinance has been prepared which would prohibit the resale of cable television ser- vice at a rate higher than or different from the rate established by the City of Chula Vista for apartment units in multiple family projects. The effect of this ordinance would be both to protect the consumer and to deprive unscrupulous individuals from the opportunity to make substantial sums of money trading upon the efforts of the franchised cable operation in the City. This ordinance was placed on its first reading at the meeting of December 5, 1972, and is now ready to be placed on second reading and adoption.
