Specifically, it states that the City shall not refuse to grant a permit or approval . of work to any person who does not possess a plumbing - � contractor's certificate or registration. At the meeting of August 22, a motion to place the - ordinance on its second reading failed by the following vote: � Ayes: Councilmen Scott, Hamilton " � • Noes: idone Absent: Councilmen Hyde, Egdahl " Abstain: Councilman Hobel Councilman Hobel abstained since he was not present at the public hearing. � A motion was then made by Councilnan Scott �to bring this matter back at the meeting of September 5, when a full Council will be present. Staff Commentary on Aqenda Item No. � CHULA VISTA CITY COUNCIL MEETING OF August -L�; 1972 Item Title: _ Ordinance - Amending Section 23. 1 of the Chula Vista City Code, as Amended, by Adding Thereto Certain Provisions Relating to � the Requirement of Special Plumber Gertification - First Reading Initiated by : City Attorney Aftached is ' a copy of Resolution [ ] Ordinance [ aJ Agreement [ ] Plat [ ) Background: Recently, the City of Chula Vista has been sued by the Laborers International Union in the Federal Court for violation of inter alia the 1964 Civil Rights Act. The grounds of the complaint were that since �}-e adopted this section of the Uniform Plumbing Code, which required a plumber to be certified in addition to being licensed, and since this certification had been applied in racially discriminatory ways, the City of Chula Vista �vas perpetrating arbitrary discrimination. The Building Department has informed me that this certification is, as a practical matter, never required and that if a plumber is licensed by the 'State, this is enough evidence that he is qualified.
