CHULA VISTA CITY COUNCIL MEETING OF July 25, 1972 Item Ti tle: Resolution - Approving Second Amendment to Civil Defense and Disaster Agreement Initiated by : City �tanager Attached is a copy of Resolution [ ) Ordinance [ ] Agreement [ ) Plat [ ) Background: The California Disaster Act of 1950 established a statecaide preparedness program and required equival.ent programs in local governments. In 1970 this Act was revised and replaced by the California Emergency Services Act. The new act changed the name of the statewide program to the "Emergency Services Program" administered by the "California Office of Emergency Services" in the office of the Governor. The proposed amendment merely alters the terminology of the agreement to conform with the California Faaergency Services Act of 1970. The proposed changes have been reviewed and approved by the County Counsel and the Assistant City Attorney of Chula Vista. See EXHIBITS [ ] No. Financial Statenent: N.A. Co.mmission-BOard N.A. Samuel Blick, Assistant City Attorney �/�' � S UBJECT : Amendment to Civil Defense Agreement and Proposed Emergency Organization Ordinance A review of the proposed emergency and functions ordinance indicates that i [ differs 'only slightly from the present existing Chula Vista Resotution No. 3048. • The chan9es it offers, although not substantial , appear to be in order, and 1 see no objection to adopting the new ordinance. Furthermore, the amendment to the Civil Defense and Disaster Agreement is merely pro forma. The changes it proposes are technical in nature and merely alter the terminology of the agreemeni. Therefore, it is my opinion that both the amendmen[ to the agreemen[ and the proposed ordinance are acceptable and should be brought before the Council at your earliest convenience. The amendments are technical in nature and do not affect the obligations and duties of the parties to the con'tract. Although tne a�reement could have been redrafted and submitted to the parties, using the procedure oi amendin� the existing a�reement may avoid problems regarding the substantive provisions of the agreement. - In your letter dated biay 1, 1972 to this office you also attached a copy oi' tlie so-called Pdodel Cities Ordinance and ' asked that this ofiice revieri the ordinacice as to its form before you distribute it to the various city members. The Idodel Cities Ordinance appears to be substantially the same as those presently adopted by tne Cities of' the �an Diego, Vista and Del Mar. This oYiice sees no objections to the Ordinance, You also referred to this of=ice £or consideration a proposed revision of the existing San Diego County Civil Defense and Disaster Ordinance. This Act has been replaced by the California Emergency Services Act that became law in December 1970. The new act retains the substance of the old Act; changes the name of "Civil Defense and Disaster" to "Etaergency Services"; streamlines the provisions of the old Act; changes the terminology on declarztions of disaster; and incorporates into law interpretations by the -•Attorney General on some provisioas of the old Act. During calendar year 1971 the California Office of Emergency Services developed model ordinances for cities and counties. The attached ordinance has been reviewed and approved by the Attorney General, T.he County Counsel, and the Assistant City Attorney of Chula Vista. See EXHIBITS [ j No. Financial Statemen t: N.A. SECOND AMENDPIENT TO CIVIL DErENSE AND DISASTEA AGREEP4ENT THIS SECOND AI�iEND�fENT TO AGfiEEi•IEIQT entered into this day of , 1972 by and between the COUNTY OF SAP? DIEGO, hereinafter referred to as "County" and the incorporated cities - within the County of San Diego, hereinafter referred to as "City" or "Cities" . W I T N E S S E T H WHEAEAS , the County of San Diego , hereinafter referred to as "County" and the incorporated cities within the County of San Diego, hereinafter referred to as the "City" or "Cities" have previously �entered into tre Civil Defense and Disaster Agreement (County of San Diego Contract No. 3533-�7oo-E) for the purpose of preparing mutual plans for the preservation and safety of life and property in cases of emergency and to provide for mutual assistance in such an event ; and • WHEAEAS, on April 21 , 19�2 the Unified San Diego County Civil Defense and Disaster Council adopted and recommended the approval of the herein contained amendments to the heretofore mentioned Agreement; NOW THEBEFORE, � IT IS AGREED as follows : 1. That the title of said agreement between the "County" and "Cities" is amended to read as follozas : EMEAGENCY SERVICES AGREEi1ENT 2. That all references in said agreement to the "San Diego County Civil Defense and Disaster Organization" are amended to read _� � �- � � zQ� ��8 #6 as follows : Unified San Diego County Emergency Services Organization 3. That all references in said agreenent to the "Unified San Diego County Civil Defense and Disaster Council" a*e amended to read as follows : Unified San Diego County Disaster Council 4. That all references in said agreement to the "Coordinator of Civil Defense and Disaster" are amended to read as follows : Coordinator of Emergency Services 5. That all references in said agreement to "civil defense" or "civil defense and disaster" are amended to read as follows : emergency services 6. That paragraph A(1) of said agreement is amended to read as follows : Aid , assist and advise each city in the preparation and development of an emergency plan for that city. �. That paragraph A(2) of said agreement is amended to read as follows : . " Prepare and develop a County-wide emergency plan which shall provide for the needs of the contracting cities and of the unincorporated areas of the County and which in addition will take into account and be coordinated with the needs of the cities in the event of a ma�or natural disaster. _2_ � g - 8. That paragraph A(3) of said agreement is amended to read as follows : Aid , assist and advise the cities with the training of public employees for the city emergency services organization 9. That paragraph B(3) of said agreement is amended to read as follows : Accept primary responsibility for the development within that. city of an emergency plan which shall be compatible with and complementary to the County-wide emergency plan and organization to be developed pursuant to paragraph A(2) above . 10. That paragraph F(1) of said agreement is amended to read as follosvs : To request the Board of Supervisors to proclaim the existence or threatened existence of a lecal emergency and the determination thereof if the Board of Supervisors is in session or to issue such proclamation if the Board of Supervisors is not in session subject to ratification by the Board of Suoervisors at the earliest practical time. 11 . All other terms and conditions of said agreement shall remain in full force and effect .
