Staff Commentary on Aqenda Item No. CHULA VISTA CITY COWCIL MEETNG OF July 11 , 1972 Ite m Title: Public Nearing - Consideration of change of zone for 4.69 acres located on the west side of Broadway, south of H Street, from C-T and R-3 to C-T-P Initiated by • Director of Planning Aftached is a copy of Resolution [ ] Ordinance [ ] Agreement [ ] Plat [ ) Bac;:qround: The applicant requested rezoning from R-3 and C-T to C-T-P on 4 acres of vacant property on the 4iest side of Broadway approximately 290 feet south of H Street. The Planning Commission included t�vo additional parcels for consideration of rezoning; there �aere: (1 ) a 145' X 150' C-T zoned parcel developed �vith a bank and directly northeast of the applicant's property; (2) a 100' X 100' R-3 zoned parcel developed �•�ith an 8 unit apart- ment, located northwest of the subject property. Piadison Avenue presently deadends on both sides of the applicant' s property since it was originally intended to extend through bett•reen H and I Streets. In 1961 a request tvas made to rezone the entire parcel to C-2 (the C-2 zone was the approximate equivalent of the present C-T zone). The easterly 125' was already zoned C-2, with the remaining area zoned R-3. The City Council decided at that time to rezone only the easterly 350 feet to C-2 and leave the �•iesterly 250 feet zoned R-3. In that manner, if the t�vo ends of Madison Avenue �aere extended and connected it would leave 100 feet of R-3 zoning on each side of the street. As a result of this action the applicant's property is split into t�ao zones with the easterly 350 feet zoned C-t and the �aesterly 250 feet zoned R-3. The adjacent zoning and land use are: North - R-3 and C-T Apartment, Market and Service Station South - R-2 and C-T Duplexes and Restaurants , East - C-C Shopping Center West - R-1 Single Family Homes The Cor�nission recently approved the rezoning of two lots on Mankato Street behind the Butcher Shop restaurant to C-T-P in order to provide additional parking for the restaurant. The applicant submitted a plan for the development of the property locating three one- story buildings, one to be used for offices and the other t�vo- for retail sales . The office building �vill contain 15,000 square feet and the retail sales buildings 32,000 and 4,050 square feet. The plan also indicates an expansion of the existing drive-through facilities for Southern California First iVational Bank located on Broad��iay. Only the larger retail sales building is slated for construction during the first phase of development. Access to the property will be provided from Broadway and the north segment of Nadison Avenue. Because of the proposed expansion of the drive-through facilities for the bank, their parcel �vas included in the request to avoid possible conflicts in the traffic circu- lation on and off the site. The present drive-through facilities exit out onto Broadsaay by way of a drive�aay adjacent to the south end of the bank building. The architecture of the building has a "wing" �vall extending to the side��alk adjacent to Broado-iay creating a hazardous situation by limiting the visibility of anyone exiting from the site. The 100' X 100' parcel on �4adison Avenue, with the 8-unit apartment building, �•�as included in order to create a more logical zone boundary if the request were approved. If the parcel �vere not rezoned, it �•iould be the only parcel in the area zoned R-3. Another reason for its inclusion is that the status of the property would probably change due to the lot being surrounded by commercial development. The obvious questions which arise from this request are: Is the expansion of the coimnercial necessary or desirable; and, is the present R-3 zoning proper or adequate? In 1961 the present R-3 zoning ��as left in its present state so development could occur on both sides of t�ladison Avenue, once connected. The depth would be 100' on each side. This depth may have been adequate in 1961 but the changes in the Ordinance since then, such as more required parking and open space, would probably prove that the depth �aould be marginal at best. Even if development �•rere allowed �aithout �4adison Avenue going through, the location of the property to the adjacent commercial uses may be undesirable. Under normal circumstances, the commercial depth of 350 feet would be adequate. The property to the north is, however, zoned commercially from I�iadison Avenue to Broadway, a distance of 450 feet. This, coupled with the fact that the property would probably permit only marginal R-3 development, would more or less indicate that the expansion of the comnercial is a logical choice as long as the adjoining residential areas are protected. The Precise Plan procedure �aill help to insure compatibility by precisely locatin9 the proposed uses. The applicant' s plan designates a single story office building located 43 feet from the R-1 zone. The inclusion of the bank property in the request will insure proper coordination of traffic circulation between the developer' s plan and the bank. The Engineering Division has expressed some concern with traffic exiting onto Broad�aay from the bank; the appli- cant's plan would alleviate the problem. Goldberg and I�titchell N. Angus on the 19th day of h1ay, 7972> Document t�umber PCZ-72-L, and WHEREAS, said application requested that a vacant 3.97 acre parcel located on the west side of the 500 block of Broadway, south of "H" Street, more particularly described in said Document, be reclassified from C-T and R-3 to C-T-P, and i WHEREAS, the Planning Department included for consideration of reclassification to C-T-P a 745' X 750' parcel developed with a bank at the northeast corner of - the applicant's property, located on Broadway in the C-T zone, and a 700' X 100' ' parcel developed with an 8-unit apartment at the northwest corner on Madison Avenue in the R-3 zone, making the total area under consideration 4.69 acres, and WHEREAS, Chula Vista Square - Frank M. Goldberg and Mitchell N. Angus sub- mitted a precise plan showing the location of three one-story buildings, one to , be used for offices and the other two for retail sales, indicating an expansion drive-thru facilities for Southern California First National Bank, and delineating the parking facility and circulation pattern, and WHEREAS, the Planning Comnission set the time and place for a hearing on said application, and notice of said hearing, together with its purpose, was given by the publication in a newspaper of general circulation in the City at least ten days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. , June 5, 1972, Council Chamber, Civic Center, 276 Fourth Avenue, before the Planning Comnission, and said hearing was thereafter closed. NOW THEREFORE BE IT RESOLVED AS FOLLOIJS: ' 1. From facts presented to the Cortmission, the Comnission finds that ' public necessity, convenience, general welfare and good zoning practice require � the change of zone from C-T and R-3 to C-T-P for 4.69 acres located an the west side of Broadway, south of H Street, and approval of the Precise Plan ' . for development subject to the following conditions: a. The entrance from Madison Avenue shall be clearly marked to identify the shopping center, to enable motorists to determine they are / entering private property. S �o � , . b. A 6' higl oden fence shall be erected on the N. .perty line between the apartments to the north. � c. The height of the masonry wall on the south and viest property lines , shall be coordinated with the adjacent owners to determine the actual height. The height of the wall shall be relatively constant, with the differences in height to be based on topography. d. A pedestrian access shall be provided from the south segment of Madison Avenue. e. The south segment of Madison Avenue shall end in a cul de sac in accordance with Engineering Division recommendations. f. Future buildings shall maintain a 75' setback on Broadway. g. The applicant shall pursue, o-iith the adjacent oo-mer to the north, - installation of alley type returns for the driveway north of the bank building and the driveway on Madison Avenue at the 40' easement. h. The property shall be landscaped in accordance with the Landscaping Manual of Chula Vista. i. The existing utility lines on the property coinciding with the extension of Madison Avenue shall be undergrounded. j. A coordinated sign program shall be submitted at the time of application for a building permit. k. The zoning walls and fences, the cut de sac on Madison Avenue and the undergrounding of the utilities on the property shall all be accomplished during the first phase of development. l. Redevelopment of the existing apartment building on Madison Avenue, for comnercial purposes, will require the submission of a Precise Plan for � Planning Comnission approval . m. A sewer easement shall be granted to the City of Chula Vista in accordance with the accepted standards of the Engineering Division. 2. The findings of fact in support of said determination are as follows: a. The present R-3 zoning would permit only marginal multip7e family development and the proposed expansion of the comnercial will be in keeping with the existing comnercial dimensions in the area. The Precise Plan will insure compatibility of the comnercial development with adjacent residential areas. � y a•° , • b. The Planning Comnission recomnends to the City Council that said reclassifi- , cation be 9ranted. 4. That this resolution be transmitted to the City Council .
