RESOLUTION OF THE C[TY COU?�'CIL OF THE CITY OF
CHULA VISTA APPROVING THE SECOND AIvIEND?�4ENT TO
THE MEMORANDUM OF UI�'DERSTAI�iDII�'G (A40U). DATED
?vOVEA4BER 16. 2007. AI�40NG THE COPERMITTEES OF SAN
DIEGO COUI`'TY NATIONAL POLLUTAI�'T DISCI3ARGE
ELIMII�TATIOI�' SI'STEM MUI�TICIPAL PERMIT. AIvD
AUTHORIZII�'G THE MAYOR TO SIGI�' THE SECOI�TD
AMEI�TDA�fEI�TT ON BEHALF OF THE CITY
R'HEREAS_ the United States Environmental Protection Aeenc}� (USEPA) proposed
reeulations (published December 8, 1988 in the Federal Reeister) for the issuance of I�'ational
Pollutant Discharge Elimination System (NPDES) Municipal Permits (Municipal Permit) to
regulate storm ���ater discharges into the waters of the United States; and
VJHEREAS, the USEPA re2ulations require I�'PDES permits for discharees from
municipal storm drains on a system-w�ide orjurisdiction-���ide basis: and
WHEREAS. pursuant to the Federal Clean V�'ater Act and the California Porter-Coloane
Vl'ater Qualiri� Act, the Regional Boazd issued permits to the San Diego Counn Copermittees in
1990, 1999 (Tentative Order). 2001. 2007, and 2013; and
V�%HEREAS, the San Dieeo Municipal Permit is system-«�de, coverine all jurisdictions
of San Dieeo Counn�: and
V�'HEREAS, the Municipal Permit requires all parties (named as Copermittees) — the
Counri� of San Dieeo. the San Diego Unified Port District, the San Diego County Regional
Airport Authoritv, and the incorporated Cities of San Diego County — to collaborate in the
development and implementation of reeional and watershed urban runoff manaeement plans,
including the ezecution of an agreemenr, and
Vl'FIEREAS, since 1990, ���hen the Resional Water Quality Control Boazd (Regional
Board) first adopted the I�'PDES Municipal Permit for San Dieeo Counn�. the Cin� of Chula
Vista has been cooperatine with other Copermittees in the implementation of reeional proerams;
and
\'�JHEREAS, this cooperation has necessitated entering into several asreements (or
1�40Us) throuehout the vears for shared program responsibilities and costs; and
WHEREAS, the n40Us are modified approximatel}� e��en� fi��e .�ears. concurrent �rith the
re-issuance of the NPDES A4unicipal Permit, to address specific permit requirements, and to
define associated Coperminees' shared reeional responsibilities and financial obligations: and

V�'HEREAS; the MOU establishes the shared program responsibilities of each party with
respect to compliance with the Municipal Permit regulations, which are administered by the
Regional Board; and
WHEREAS, it is necessary for the Copermittees to continue current regional program
activities at least to June 27, 201�; at which time many regional activities will be replaced by
similar watershed acti��ities under separate watershed agreements; and
WHEREAS. the cunent regional MOU will eapire on May 8, 2014; and
WHEREAS, the proposed Second Amendment to the MOU will extend the term of the
MOU to August 31, 2015.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula
Vista, that it hereby approve the Second Amendment to the Memorandum of Understanding
(MOU) Among the Copermittees of San Diego County, dated November 16, 2007, for the
National Pollutant Discharge Elimination System Municipal Permit.
BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista, that the
Mayor of the City of Chula Vista is hereby authorized to execute said MOU for and on behalf of
the City of Chula Vista. Further, the City Counci] delegates to the City Manager the option to
enter into additional amendments so long as an amendment does not require an e�penditure of
greater than $50,000.
