ORDII�'ANCE OF THE CITY OF CHULA VISTA APPROVII�'G A
PRECISE PLAi�' (PCM-li-22) TO ALLOW A HEIGHT OF 120
FEET (4� FEET MAXIMUM CURRENTLY ALLO�i'ED) TO
ACCOMMODATE A PROPOSED PARKING STRUCTURE TO
BE LOCATED VJITHII�' THE SHARP CHULA VISTA MEDICAL
CENTER CAMPUS LOCATED AT 7�1 MEDICAL CEI�TTER
COURT
A. PROJECT SITE
V�'HEREAS, the area of land w�hich is subject to this Ordinance is diagrammatically
represented in Ezhibit"A" attached to this Ordinance, and commonly l;no�m as Sharp Chula Vista
Hospital campus, and consists of site located at 7�1 Medical Center Court (`Project Site '); and
WHEREAS, a dul��verified application was filed H�th the City of Chula Vista Development
Sen�ices Department on November 26, 20li; by Sharp Chula Vista Medical Center (SCMC)
(`Applicant'),(`Oti�ner'and"Developer`)requestin2 approval of a Precise Plan in order to allow for
the maximum buildine height to be increased from 4� feet to 120 feet ); and
B. PROJECT, APPLICATION FOR DISCRETIONARY APPROVALS
WHEREAS.the applicant has complied ���th the requirements of Section 19.�6.042 of Chula
Vista Municipal Code(Required maps and inFormation)by providing an application submittal packaee
which includes detailed site plans and elevations; and
WHEREAS, the Project consisu of developing a six story pazl:ine structure (seven le��els)
consisting of 718 pazking spaces; and
C. PLANNING COMMISSIOI�' RECORD OF APPLICATION
WHEREAS, the Planning Commission set the time and place for a hearing on the
Project; and notice of the hearing, together H�ith its purpose, H�as given by its publication in a
ne��spaper of general circulation in the City, and its mailine to propem�owners�vithin 500 feet of
the e�terior boundarv of the Project, at Ieast ten (]0) days prior to the hearing; and
WHEREAS. the Plannine Commission held an advertised public hearine on the
Project on March 12, 2014, and voted �-1-1-0 to fonvard a recommendation to the Ciri-Council on
the Project; and
R'HEREAS, the proceedines and all evidence introduced before the Plannine
Commission at the public hearing on this project held on March 12; 2014, and the minutes and
resolution resultine therefrom, are hereb�� incorporated into the record of this proceeding; and

D. CITY COUNCIL RECORD OF APPLICATION
WHEREAS. the City Clerk set the time and place for the hearing on the Project
application and notices of the hearing, together with its purpose, was given by its publication in a
newspaper of general circulation in the city,and its mailing to property owners within 500 feet ofthe
exterior boundaries of the Project at least ten (]0) days prior to the hearing; and
WHEREAS,the duly called and noticed public hearing on the Project was held before
the City Council of the City of Chula Vista on April 15, 2014, in the Council Chambers in the City
Hall; City of Chula Vista Civic Center, 276 Fourth Avenue, at 2:00 p.m. to receive the
recommendations ofthe Planning Commission,and to hear public testimony with regazd to the same;
and
E. DISCRETIONARY APPROVALS RESOLUTiON AND ORDINANCE
WHEREAS, at the same City Council heazing at which this Ordinance was introduced for
first reading on April 15,2014 the City Council ofthe City of Chula Vista approved Resolution No.
2014-063, by which it approved a Design Review Permit for the Project; and
F. ENVIRONMENTAL DETERMINATION
WHEREAS, the Development Services Director has reviewed the proposed project for
compliance with the California Environmental Quality Act (CEQA) and has determined that the
project qualifies for Class 32 categorical exemption pursuant to Section 15332(In-Fill Development
Project) of the State CEQA Guidelines.
NOW, THEREFORE, the City Council of the City of Chula Vista does hereby find,
determine and ordain as follows:
Section 1
NOW;THEREFORE,BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF
CHULA VISTA MAKE THE FOLLOWING FINDINGS PURSUANT TO CHULA VISTA
MLTN[C[PAL CODE SECTION 19.14.576:
A. PRECISE PLAN FINDINGS
The Citi� Council finds by clear and convincing evidence that:
SUCH PLAN WILL NOT, UNDER THE CIRCUMSTANCES OF THE PARTICULAR
CASE, BE DETRIMENTAL TO THE HEALTH, SAFETY OR GENERAL WELFARE OF
PERSONS RESIDING OR WORKING IN THE VICINITY,OR INJURIOUS TO PROPERTY OR
IMPROVEMENTS IN THE V]CINITY

The Precise Plan bein2 requested is limited to allo�iine a deviation from existine
development standazds for building height w�ithin the esisting hospital campus. The hospital campus
has been in development for approximately 3� }�eazs and contains tti�o esisting towers of
approximatel��68 feet in height. The pazking svucture beine proposed is an important component of
the oneoine medical center expansion and w�ll ensure adequate pazl:ing for patienu and medical staff
usina the medical center facilities. Therefore, its construction. alone writh additional support
facilities. �vill contribute to the general well-being of the communiri�.
The parkine structure will be located adjacent to or near e�isting hospital facilities well
within the campus boundaries. The parkine structure is located approYimatel}� 167 feet from the
nearest residential propem�located to the northeast ofthe project site. Building desien is consistent
w�ith City Desien Guidelines. The parking structure ��ill not eenerate an}� new traffic.
The proposed heieht increase is to allow development consistent«�th hospital uses. Existine
to�vers on site are appro�imately 67 feet in heieht. The Project w�ill contribute to the w�ell-being and
general welfare of the Chula V ista residents by allow�ng the existine hospital facility to operate more
efficientiv to meet the needs of the Chua Vista and South Bav residents.
THAT SUCH PLAN SATISFIES THE PRINCIPLE FOR THE APPLICATION OF THE P
MODIFYING DISTRICT AS SET FORTH IN CVMC 19.56.041
The Precise Plan (P) Modifi�ino District was attached to the C-O zoning at the time the
subject property H�as rezoned from R-1-H to C-O-P in Januarv, 1990. The site has been developed as
a hospital campus since approximately 1970. The hospital site had received prior approval for t�-o
hospital towers H�ith a heieht of approtimately 68 feet; prior to the effective date of this rezone.
Given the esisting hospital use; the P modifier �vas added to this ne�v zoning designation in
anticipation of the need to pro��ide future flesibiliri in the implementation of the underl}�ine
development standards of the C-O zone, especially the abilin� to provide for structures which
exceeded the underlying 45 foot height limit. The Precise Plan will allo�;�for flexibiliri�in buildine
height that��ill enable the site to be developed consistent with the needs of a state of the art medical
facilitv.
THAT ANY E�CEPTIONS GRANTED WHICH DEVIATE FROM THE UNDERLYII�'G ,
ZOI�TII�'G REQUIREMEI�'TS SHALL BE V�'ARRANTED ONLY}�'I�I�i NECESSARY TO MEET
THE PURPOSE AND APPLICATION OF THE P PRECISE PL.�N MODIFYII�'G DISTRICT
Esceptions to the underl��ine zonine requirements are �varranted due to the fact that the site
contains an existing hospital campus. Such use is unique ���ithin the C-O zone in that hospitals
usually contain buildings/towers that are over 4� feet in height. The inabiliri for future de��elopment
to elceed the current hei�ht limit of 4� feet would preclude the abilin� to provide necessan�
e�pansions that meet the needs of the surroundine community.

THAT APPROVAL OF THIS PLAN WILL CONFORM TO THE GENERAL PLAN AND
THE ADOPTED POLICES OF THE CITY
Approval of a Precise Plan is consistent with the Public/Quasi-Public designation of the
General Plan for the property and t6e General Plan Objective PFS 19 to provide art and culture
programs, childcaze facilities and health and human services that enhance the quality of life in the
City of Chula Vista. A height exceeding the current height restriction of 45 feet under the C-O
(Administrative and Professional Office) zone, has been established by the two existing hospital
towers on the campus and will allow the site to be developed consistent with the needs ofthe state of
the art medical facility.
B. ADOPTION OF PRECISE PLAN
In light of the findings above, the Precise Plan is adopted to increase the existing building
height limit of 45 feet to 120 feet as set forth and diagrammatically represented in Exhibit"A"and
described in Exhibit"B",approved and adopted in the form presented to the City Council and on file
in the office of the City Clerk.
Section IL Severability
If any portion of this Ordinance, or its application to any person or circumstance, is for any
reason held to be invalid,unenforceable or unconstitutional,by a court ofcompetentjurisdiction,that
portion shall be deemed severable,and such invalidity,unenforceability or unconstitutionality shall
not affect the validity or enforceability ofthe remaining portions ofthe Ordinance,or its application
to any other person or circumstance. The City Council of the City of Chula Vista hereby declares
that it would have adopted each section,sentence,dause or phrase of this Ordinance,irrespective of
the fact that any one or more other sections, sentences, clauses or phrases of the Ordinance be
dedared invalid, unenforceable or unconstitutional.
Section III. Construction
The City Council of the City of Chula Vista intends this Ordinance to supplement, not to
duplicate or contradict,applicable state and federal law and this Ordinance shall be construed in light
of that intent.
Section IV. Effecti��e Date
This Ordinance shal] take effect and be in force on the thirtieth day after its final passage.
Section V. Publication
The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause
the same to be published or posted according to la�i-.
