During the past 4-1/2 years of use, the need for several modifications to the ordinance has become apparent. Addi- tionally, the City has adopted a new Landscape Manual which in turn necessitates some of the proposed changes. The Public Works Depart- ment has reviewed the grading ordinance in its entirety. It has also received input from selected private engineers and interested County-c�ide organizations. The major changes from the existing or- , dinance are outlined as follows: 1. The maximum normal steepness of cut slopes was flattened £rom 1-1/2 : 1 slope to 2 : 1 slope. This change was required .primarily to facilitate the landscaping and maintenance of slopes. This change will also bring the local ordinance into conformity with the Uniform Building Code in regard to slope steepness. 2 . A provision was included that all grading shall be in accordance. with the City Landscape Manual. . 3. A new section entitled "Inspection of Grading Operations - Re- sponsibility Therefor" sets fort}i the responsibilities of the City Engineer, the private engineer, the soils engineer and the landscape architect to conduct various inspections during the course of the work. 4. However, only minor changes have been made in the overall fees collected. No significant financial impact to the City is anticipated. A new section entitled "Transfer of Responsibility for Ap- proval" requires that if the private enqineer, soils engineer, landscape architect, or engineering geologist of record are . changed during the course of the work, the work shall be stopped until the replacement has agreed to accept the re- sponsibility within the area of their technical competence for approval upon completion of the work. 6. Section 15. 04 . 100 entitled "Building Construction-Land Develop- ment Permit Required - Prerequisite to Building Permit, " has been modified to require certification that rough grading has been completed prior to issuance of a building permit. See attached forms PW-E-106A and PW-E-106B. 7. Several sections of the existing code deal with the establish- , ment of a board of land development appeals. These sections have been eliminated from the oridnance. No appeal to con- ditions imposed has been made since adoption of the grading x ordinance. The proposed ordinance provides simply that an applicant may appeal the City Engineer' s denial or conditions of approval of a plan directly to the City Council. 8. An upward revision has been made in the amount of fee to be collected at the time of submittal of the plans. The revi- sion will assure reasonable compensation to the City when a development. fails to proceed beyond plan .checking. The overall permit fee has not been significantly changed. The revised ordinance requires that 508 of the permit fee be collected at the time o£ submission of the plans for review by the Public Works Department. This fee is non-refundable. At the present time, an application £ee of only $15 is charged for plan check- ing and review. This revised plan checking fee will generally reflect the cost incurred by the City. 9 . Various other sections were modified so as to (a) increase the responsibility by the private technical consultants and (b) assure a higher degree of conformity with plans, permits and City standards and regulations. Private engineers and construction industry representatives who pro- ' vided input during formulation of this ordinance were generally in ' opposition to the change from �l-1/2: 1 maximum slope steepness to a , 2 : 1 ratio. However, staff has utilized the flatter slope in the ' ordinance for the following reasons: ' 1. The 2 : 1 ratio is now used by most agencies in this area; � 2 . The 2: 1 ratio is in conformity with the Uniform Building Code; 3. The 2: 1 ratio is far more practical in terms of installation and maintenance of landscaping. 4. Flatter slopes are characteristically less subject to structural failure and erosion. A steeper-than-standard slope is, however, still permitted since the proposed ordinance provides for deviations from slope ratio standards to be approved by the City Engineer when so justified through the submission of technical supportive data. Another major area of concern by private engineers and construction industry representatives involves the timing of landscape planting. That group was generally in opposition to landscaping slopes prior to completion of dewlling unit construction. However, in the past� i147 � , . • ;, . The subsequent repairs and planting were unneces- • sarily difficult to obtain. Consequently, the proposed ordinance provides that at least the slopes in excess of 15 feet in height will � be planted prior to issuance of building permits. To obtain an approval of the rough grading phase, the follow- ing items must be completed and approved: 1 . A compaction report when required by the permit. 2. Form PW-E-106A. 3. All drainage facilities and rough grading per the approved plans. 4 . The property lines flagged and staked. 5. Al1 cut and fill slopes in excess of 15 feet vertically planted. Required irigation system shall be installed at the discretion of the City official. Zn addition, at the discretion of the City official , any slope that is consid- ered a potential erosion hazard must also be planted. When all the above work is completed, please contact the Depart- ment of Public Works, Construction Inspection Division, tele- phoned 575-5028 , for an inspection. PW-E-106B q1
