A. BACKGROUP�D
• l . At the City Council meeting of January 10, 1978, the Council adopted an urgency
ordinance (Ordinance No. 1784) rezoning the property at 11 Third Avenue from C-0 to C-C.
The ordinance will remain in effect for a period of 90 days and will expire on April 10,
1978. The purpose of this request is to permanently establish the C-C zoning on the
property.
' 2. An Initial Study, IS-78-47, was certified by the Planning Corrmiission on
February 8, 1978 and is forwarded to Council .

' 2. Proposed rezoning
a . North Glover Avenue has recently been realigned, placing a portion of C-0
zoned property at the northwest corner of the new alignment. This property and a portion
of "C" Street, which has been vacated, are now part of the Department of t4otor.Vehicles
site which is zoned C-C. The rezoning of this property to C-C is appropriate. _

On February 8 the Planning Corrmiission, by a 6-0 vote, certified the Negative Declaration
on IS-78-47 and recommended that the City Council .approve the change of zone at the north-.
east and northwest corner of Third Avenue Extension and North Glover Avenue from C-0 to C-C.

what remains of the former D.M.V. site. The property contains 0.37 acres and is developed
with a 5,000 sq.ft. building occupied by a driving school , optometrist, and law office.
A portion of the building is vacant. The parking is located on the adjacent parcel to
the east which is also owned by the owner of the northeast corner. The parcel is split
zoned, C-0 and R-3-G. It is appropriate that the 0.37 acre parcel be rezoned to C-C_
„ because of its close proximity to areas which are also zoned for retail commercial uses.
� The staff does not recorranend that the remainder of the C-0 zoning along the north side
of Third Avenue Extension be rezoned to allow retail commercial uses. This is due
primarily to the depth of the present C-0 zoning which is relatively shallow and the
fact that the character of the street begins to change toward the east. In addition,
any extension of the rezoning would require an amendment' to the General Plan. The area
;, used for parking can remain split zoned and still continue to be used for parking. If
the corner is redeveloped, the inclusion of this property into the C-C zone can be
studied at that time.

II� �;!HEREAS, on January 19, 197E the City Council adopted Ordinance No. 1784,
� rezoning certain property consisting of a parcel located at 11 Third Avenue,
from C-0 to C-C on an interim basis, and
41HEREAS, the City Council referred the matter to the Planning Commission
`or consideration of rezoning on a permanent basis, and
l•1HEREAS, the City Planning Commission set the time and place for a public
hearing for the purpose of considering the change of zone on properties located at
the north�•iest and northeast corners of Third Avenue Extension and Plorth Glover
Avenue, from C-0 to C-C, and
I•lHEREAS, an Initial Study, IS-78-47, o-ias conducted by the Environmental
Revie�v Corranittee on January 26, 1978, o-�hich concluded that there would be no
significant adverse environmental impact as the result of the rezoning and
issued a draft Negative Declaration, and
l•1HEREAS, a hearina �aas held at the time and place as advertised, namely
7:00 p.m. , February S, 1978, before the Planning Commission and said hearing was
thereafter closed.
i`!04! THEREFORE BE IT RESOLVED AS FOLLO!•JS:
l . The Commission finds that in accordance tiaith the Negative Declaration
on IS-7II-47 and the findings stated therein, this rezoning �vill have no significant
adverse environmental impact and certifies that the Plegative Declaration was
prepared in accordance with the California Environmental Quality Act of 1970,
as amended.
2. From facts presented to the Commission, the Comnission finds that
public necessity, convenience, general welfare and good zoning practice require the
change of zone for property at the northwest and northeast corners of the intersection
of Third Avenue Extension and Plorth Glover Avenue, as shown on the attached
locator, from C-0 to C-C.
3. The findings of fact in support of said determination are as follows:
a. It is good zoning practice to have a parcel which is developed with
one building to be in one zone. The rezoning of the northwest corner
of Third Avenue Extension and PJorth Glover Avenue is an appropriate
extension of the retail comnercial boundary which extends along the
�� 4/ west side of North Glover.
' � b. The northeast corner is roithin close proximity to other properties
in the area :•�hich are zoned C-C. The general character of this
property is more in keeping with the retail commercial uses and
should therefore be rezoned to allow retail commercial .
c. The proposed rezoning is loca�ed in an area on the General Plan
�,ihich can be interpreted to be retail corrmercial or professional
and administrative commercial . The exact boundaries are not
defined on the 6eneral Plan, therefore, the proposed rezoning is
' consistent ��ith the land use element of the General Plan.
4. The Planning Cormnission recorrunends to the City Council that said change
of zone be approved.
5. ;That this resolution be transmitted to the City Council .

The project involves about . 5 acres of property located at the
r.ortheast and northwest corners of 3rd and N. Glover Aves . (Exhibit

T:�e site is subject to back:aater flooding in tne even't of a 100 year
flooc. An inferred fault is susaected of traversing the �roject area.
B. Project Description �
The project involves the rezonina ,of the subject site from C-O-F to
C-C-P. \'orth Glover Ave_ has recently been realicned placing a portion
o� C-O zoned propert_; at the. north��rest corner of the new align�en�.
This aroaerty and a portion of C St. which has been vacated , are noia
oart o� the Dept. of :•Sotor Vehicle site which is zoned C-C . The
rezor.ing of this property to C-C is aporopriate .
The northeastern corner of 3rd & D1. Glover Aves . is o-�hat remains of
the� `ormer D.i•1.V. si'te . The property contains 0 . 37 acres . Par'{inc
for �ne existing building is located on the parcel adjacer.t to the east
under the same o�•inership. The parcel is split zoned C-O and R-3-G.
It is appropriace tnat the 0 . 37 acre parcel is rezoned to C-C because
of its close proximity to areas which are also zoned for retail
commercial .uses. The staff has not recommended that the remainder oi
the C-O zoning along the northern side of 3rd Ave . be rezoried to allow
retail commercial uses . This is due primarily to the depth of the

Since the aroposed project does not proposed new construction , no
hazard to human life due to flooding is anticipated.
Geolocic I:azard .
An in•`erred fault is suspected of traversinc the project site . This
poter.tial :ault is in�erred by pnotograpnic evidence , no physical
evidence of its eYistence has been identified. If the �aul� does exist
:ai=hi:< Lhis area wnich is m�t likely underlain with sands and 'nig'r.

1. The proposed site is co:apletely developed and void of
any sianificant wildlife . The site is located within the -
S�.aeetcaater River rlood plain and is subject to backcaater
`looding in the event of a 100 }•ear flood. There is also an
in�errzd earthquake fault susoected of uncerlying the site or
nearb�� property. No impact relative to the rezoning is
' anticioa'ted due to these factors .
2 . The oroposed rezoning is consistent with the land use elemen�
o� the General Plan and is not anticiaated to achieve short ter:�
�o tne disadvantaqe of long term environmentai goals .
3. There are no potential impacts that are consider�d capable
of inte-actina to create any substantial cumulative effect on
tne; environner.t relative to the proposed rezoning.
