CITY OF CHULA VISTA COUNCIL AGENDA STATEMEiVT ' Item No. 16 For meeting of' P/3/78 ` ITEM TITLE Ordinance��7�3 - Amending the Chula Vista Municipal Code Relating to the Provision of Interim School Facilities SUBMITTED BY City Attorney ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES� NO_) At the direction of the City Council and in accordance� with new provisions of the State Subdivision Map Act, an ordinance was prepared providing for the collection of land or fees to provide an interim solution to school needs in specified attendance areaswhere overcrowded conditions are clearly demonstrated . The ordinance was reviewed by representatives of the two school districts at a meeting held in the City Attorney' s office. The ordinance was deemed satisfactory wi.th two exceptions , i .e . , the categorical exemption of one ' single-family dwelling and the trust arrangement and refund provisions for the land or fees held by the City . These changes were made removing the categorical exemption and providing for the immediate transfer of land or fees to the respective school districts; and in the event of the cancellation of a particular project, if the developer requests , a refund from the school districts may be made . The Board of Trustees can autho- ' rize such a refund. The City Attorney concurs with the changes as requested since it is believed that the less direct involvement of the City in such handling of funds or land, the better the interests of the City. The ordinance is , therefore, ready for adoption and would become effective upon first reading as an interim ordinance and later adopted in the normal manner . The Council may act upon it at the meeting of 1/3/78 or they may choose to continue the matter to the joint meeting held with the school district on 1/5/78 as a symbolic gesture of the long term cooperation that has existed between the City and the school districts . Although only the City School District will be represented at the meeting to discuss the Charter changes , representatives of the Sweetwater Union School District could also be invited to attend relative to the school fee ordinance .
