BACKGROUND — 1 . The applicant is requesting rezoning of a 9000 sq. ft. .parcel located on the northerly side of L Street, 150 feet east of Third Avenue, from R-3 to C-C, and R-3 and C-C to C-O-P (the fundamental rezoning is from R-3 to C-O-P but a minor realignment- of the zone boundary line results in the rezoning of two small triangular .pieces, see Exhibit A) for the purpose of placing an existing building (move-on) on the property which will be used for office purposes. The applicant has also submitted a precise plan. 2. An Initial Study, IS-77-25, was certified by the Planning Commission on May 11 , 1977 and is herewith forwarded to the City Council . 3. Consideration of this item before the City Council was delayed by the applicant to allow his engineer to work with the Department of Public Works to resolve a grading and drainage problem. The problem has been resolved and a grading plan was approved by the.,Director of Public Works on November 18, 1977. � 6. DISCUSSION 1 . On May 11 , 1977 the Planning Commission certified the Negative Declaration on IS-77-25 � and by a vote of 6-0 recommended that the City Council rezone the property at 287 L Street in accordance with Resolution PCZ-77-K and as shown on Exhibit A. Existing site characteristics The 9000 sq. ft. parcel under consideration for rezoning is presentl;y:a part of an "L" shaped lot (0.93 acres) with frontage on Third Avenue and L Street. The portion of the property fronting on Third Avenue is developed with a paint store and the area immediately behind the store, as well as the portion fronting on L Street, are vacant. A tentative parcel map has been approved for the division of the entire 0.93 acres into two parcels, one containing 9000 sq. ft. (project site) and the other containing 31 ,600 sq. ft. (paint store) . 4irtually the entire site would be subject to inundation during a 100 year flood. The natural drainage ditch which is an extension of the Telegraph Canyon basin, runs diagonally across the property and occupies approximately 50% of the site. The natural drainage ditch also extends onto the adjacent vacant R-1 parcel to the east. 3. Present and proposed zoning The property has been zoned R-3 since 1959. The multiple family zoning was placed on the property to create a buffer area between the retail commercial activity on Third Avenue and the single family area to the east on L Street. At the time the property was zoned for multiple family use neither the cortenercial-office zone nor the precise plan district were established. The staff and the Planning Commission concluded that zoning the property for commercial office use under the precise plan process would allow for the reasonable development of the site in a manner compatible with the adjacent single family area. The attachment of the "P" modifying district will provide needed flexibility and control of the development which is desirable because of the drainage problem and the proximity to a single family residential area. ,v �ro � / �. �Y � � ��i���5�°� ���°�.����;�'��E�� . STREET FROM R-3 TO C-O-P � WFiEREAS, a duly verified app7ication for rezoning of property was filed Nith the planning Department by K. E". Green, dba. Sweetheart Construction Company on April 15, 1977, application No. PCZ-77-K, and WHEREAS, said application requested a change of zone for property located at 287 L Street from R-3 to C-O-P, and WHEREAS, Initial Study IS-77-25, conducted by the Environmental Review Committee, concluded on March 13, 1977 that there would be no significant adverse environmental impact as the result of the rezoning and developnent of the property, and WHEREAS, the City Planning Cortmission set the time and place for a hearing on said zone change, and notice of said hearing, together with its purpose, was given � by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at the time and place as advertised, namely 7:00 p.m. , May 11 , 7977, before the Planning Comnission and said hearing was thereafter closed. NOW THEREFORE BE IT RESOLVED AS FOLLO�dS: 1. The Commission finds that in accordance.with .the Negative Declaration on IS-77-25 and the findings. stated therein, this rezoning and the development of the property will have no significant environmental impacts, and certifies that the Negative Declaration was prepared in accordance with CEQA, 1970, as amended. • 2. From facts presented to the Cortmission, the Comnission finds that public necessity, convenience, general welfare and good zoning practice require the change of zone for property at 287 L Street from R-3 to C-O-P, subject to the following precise plan guidelines: • a. All proposed structures shall be designed so as to be architecturally � compatible with the adjacent single family neighborhood. b. Buildin9s shall not exceed a height of one story. c. A7l proposed buildings shall be located at least one foot above the 100 year flood level. • � �, �� 3. "he findings of fact in support of said determination are as follows: . �- -••• • . a. Good zoning practice dictates that the property be zoned in a , manner to permit development canpatible with the adjacent residen- � 6 � tial area. While the present R-3 zoning is compatible, the site � is difficult to devElop for that purpose because it is subject to inundation during a 100 year flood. b. The property lies in an area designated partially as comnercial and partially as residential on the General Plan and can be inter- preted to be in substantial conformance whether zoned comnercially or residentially. c. Applying the "P" Precise Plan Modifying District is appropriate because most of the property is subject to flooding during a 100 year flood, and a natural drainage channel traverses the site. d. The property is adjacent to R-1 zoning where the uses are oriented toward L Street. The comnercial uses in the area are oriented toward Third Avenue, therefore, the design and layout of any use on the subject property should be reviewed with a view toward making it compatible with the single family development. e. The natural drainage traversing the .property makes it difficult for almost any use to meet the regulations of the Pfunicipal Code. The flexibility inherent in the "P" Modifying District allows for � reasonable development of the property. . 3. The Planning Comnission recormnends to the City Council that said change of zone be approved. 4. That this resolution be transmitted to the City Council and a copy be transmitted to the applicant.
