ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES NO X )
This item was first considered by the Planning Commission on September 14, 1977, at which .
time the Commission recommended that the subject property be rezoned to C-O-P. Council,
' considered this recommendation along with the zoning of the adjacent property on October 4,
1977. At that time Council referred the item back to the Planning Commission with the '
request that the Commission consider C-C-P zoning.
On October 26 the Commission reaffirmed its previous recortmendation in favor of C-O-P zoning
and split 3:3 as to whether the subject property should be zoned to the same category as the
' property adjacent on the south. At this time the Planning Commission also recommended that
any change of zone should be conditioned upon the property owner's dedication of the right
of way required for the widening of Otay Lakes Road across the entire frontage of the parcel
including the portion encumbered by the SDG&E easement.

l . Report on proposed rezoning of 2 acres `rom C-O-P to C-C-P and 1 .18 acres �rom
R-E to C-C-P on the souih:��est side of Otav Lakes P.oad, south

Director of Planning Peterson noted that this rezoning ti•�as considered by the
Planning Co �� ission on September 14 based on an application filed by t:essrs . i;or�:�an
and Ash�vill to rezone 2 acres from C-O-P to C-C-? and the sta��' s determina=ion
that the adjacent 1 . 18 acres, presentty zoned R-E, should be included in the sane
zone as the .2 acres. The staff' s recommendation at that time �•ras for denial of
the requested change from C-O-P to C-C-P and that the 1 .18 acres be rezoned to
C-O-P. '
The Planning Co�ission agreed �•�ith the findings in support of C-O-P zoning for
the 3. 18 acres and fon�iar-ded that recem�nendation to �ne City Council . In a public
hearing held on October 4 the Council determined tha� the �;orman znd Ash�+iill property
should be rezoned to C-C-P. Inasmuch as that determination ��ias not in concurrence
t•rith the Planning Cornmission's recom�mendation, it is required by la��i that this
proposal be re�erred back to the CoTU�ission for reconsideratien and a repor� bac�
� to the Council .
- i•ir. Peterson advised that despite infornation presented to tne Council by the
property o:mers, it is still the stafr''s feeling that the C-O-P zone is most
suitable for this site due to the ample supply of retail commercial zoning in
the irr.mediate area.
Chairman Chandler announced that although this is not a public hearing, th=
Commission t•:ould be t•rilling to hear -`rom the propzr�y o�;mer if he desires.
Glenn Ash:�ill , 255 Canino del Cerro Grande, adviszd that they had appealed to
the City Council because they �aere unable to appear ai �he earlier hearing be�ore
the Planning Ccm�nission, and that based on infornaiion �•tnich �hey supplied to
the Council that body hzd concurred that the C-C-P zoning should be expand�d.
He pointed out that six acres of the adjacent C-C zoned prop2rcy has no:� be2n
approved for residential developmen± ti•�hich is beina implemented. He also
reported that t:io acres �•ihich fronts on Otay La{:es Road has been sold to Par
Construction Company, t•,hicn firm is actively planning a commercial develop���nt
there. As a result of that development proposal , t:essrs . i:orman znd Ash�•iill
are receivino more inquiries �.ritn reaard to reiail cor:�ercial use of their property
than for cor�mercial office use. He exaressed their desire to marl:et_ t%ie property
and tne need, therer'ore, to obtain the zoning o-rith the most appeal to potential
users. He pointed out that prior to 1974 the entire 10 acre parcel ��as zoned
C-T-D but their atterpt co develop tne propert, resulted in a doa;nzoning action
to C-C and C=O. Ne contended that �,ricn archi :ec:ural control tne city could
be assured of commercial develop�Tent ihat rrould be co;npztible vrith the apartnents
presently under construction on the adjoining six acres . _

� In response to a question from Commissioner G. Johnson, (•1r. Peterson affirmed that
there is no other C-0 zoned property in the area but that office uses are allovred
in the G C zone.
Ccmmissioner Smith pointed out that it appears on the locator plat that the rignt
of �•,ay for Otay Lakes Road is narro�.rer for thatportion o� the road �•;hich zbuts the
� 1 . 18 acres presently zoned R-E. He felt that rezoning of that parcel should be
contingent upon the dedication of the additional right of �•iay.
It o-ras moved by Con�issioner Pressutti , seconded by Com�nissioner G. Johnson,
that the Cor��ission reports to the City Council that the original findings in
, sup�ort of C-O-P zoningfor the 3. 18 acres are still valid and the Commission
reaffirris their previousrecommendation to deny the rezoning application on tfie
2 acres and to rezone the 1 .18 acres from R-E to C-O-P.
The motion carried by the follo�•iing vote:

The motion failed to carry by the follo�,+ing vote:

' A. Environmental Setting
The subject site involves 2 . 44 acres (gross) of vacant land located
witnin and south of the San Dieyo Gas & Electric Company ' s
transnission line easement to the west of Otay Lakes Rd. Bonita
Vista Jr. Hich school is located to the northcvest and vacant land
proposed to be developed with apartments and unspeci�ied retail uses
to the south.
The site is generally level and has been disturbed to some degree.
C The southeast section of the property , adjacent to Otay Lakes Rd. ,
� SL'aPOi'tS a variety of natural veaetation that, although intermittentl �
disturbed; is in fairly healthy condition. Native grasses , blaccer y
, nod and sage brush are the predoninent species present, ho�•:ever
several Coast barrel cactus have been observed. L4ildlife species
that may reside on site or frequent the site are supposed to be the
same as those utilizing surrounding areas such as Rice Canyon to the
soutni•;est, but in less intensity due to site size and intrusion o�
man. These species could include the orange-throated whiptailec
. lizard, coast horned lizard and common kinq snake which have been
icentified by the Calif. Fish & Game Department has having critical�
poaulation levels.
The closest kno:•:n earthquake fault is the La Nacion system about 1
mile to the east. The site has been subject to indiscri�inate
dumping of debris and there may be expansive soils present.
B. Project DescriAtion
The project entails the consideration of a city initiated rezoning
of the subject acreage from R-E to C-C-P zoning. The Bonita Vista
� project so the south, is currently zoned C-O-P and C-C-P. This
� ' develoament is currently under�aay with the initial construction of
apartments on the southern 8 acres. Due to market conditions the
oroposed medical office site originally planned for the northern
tc•;o acres adjacent to the subject project site is proposed to be
rezoned to C-C-P.

The. subject ci�y initiated rezoning is intended to provide a more
consistent zone pattern with the adjacent acreage to the south.
C. Con�ormance with zonina and olans
C ' The General Plan designates property on the west side o� Otay Lakes
Rd. , north of H St. and . south of Bonita Vista Jr. high school for
retail commercial development. The proposed rezoning is in
i con •_`ormance caith the General Plan.
Also, Otay Lakes Rd. is designated as a Scenic Route. The P modi=ier
at�ached to the C-C zone will reauire corioliance with the desian
criteria established in the Scenic Route Element of the General Plan.
D. Identi •_`ication o£ environmental effects
The proposed rezonina caill allow commercial use of the �ro:,ertv
rather tnan loca censity residential , the former c�:ill aen.erate more
tra •`�ic. Also , development in an area where some encangered
veaetation is present, Foast barrel cactus), could further reCUCe
the poaulation o� that species ii not ranspianted.
These environmen�al considerations cannot be sufficiently addressed
ua�i1 saeci�ic plans are available , hoc•;ever, and when sub;nitted
will required �urther review. .

E. Fincines o•` insicnificant imoact
1. The oroposed rezoning will not result in any physical
chanae that could alter or destroy any significant veaetation
or wildli�e.
2. The oroposed oroject is in conformance witn the General
Plan and caill insure compliance caith associated elements .
3 . No impacts have been identi£ied with the proposed action
that ,could interact to create any substantial cumulative
ef�ect on the environment.
4 . The pronosed rezoning will allo�o development that could
generate a substantial increase in traf£ic , hocaever until
snecific plans to develop the property are submitted this
environmental aspect cannot be adequately discussed.
