A. BACKGROUND
1. The City Council recently amended the Municipal Code by limiting
the number of cardroom establishments in the City of Chula Vista to one
cardroom per 25, 000 residents or any fraction thereof�(Ord. No. 1738) . The
Council also adopted an urgency ordinance (Ord. No. 1746) on May 10, 1977
relating to the inclusion of cardrooms in the C-C and C-T zones subject to
a conditional use permit. The urgency ordinance will remain �in effect for
a period of 90 days unless extended by the City Council.
2. This item involves a proposed zoning text amendment to Title 19 of
the Municipal Code (zoning ordinance) permitting cardrooms in the C-C and
C-T zones subject to a conditional use permit in accordance with the urgen-
cy ordinance adopted by the City Council.
3. An Initial Study, IS-77-41, of possible adverse environmental impacts
of the project was conducted by the Environmental Review Committee on June 2,
1977. The Committee concluded that there would be no significant effects__
and made a draft Negative Declaration which is herewith forwarded for 'City ;

B. ANAI,YSIS
1. Cardrooms are licensed and controlled under Section 5. 20 of the Muni-
cipal Code. The Code limits the maximum number of tables for any establish-
ment to 8 and the maximum number of people per table to 8 or a total of 64
customers per establishment at one time. Permitted hours of operation are

: 2 . Parking standards are not being proposed at this time due to the ��
limited application of this land use. Staff would plan to address parking�
needs at the time a specific conditional use permit request is filed with
the Planning Commission.
3. Cardrooms are unclassified uses and defined as an amusement or a
recreational use which .would:,be permitted in any commercial zone subject
to approval of a conditional use permit in accordance with provisions of
the Unclassified Use section of the Code. The proposed zoning text amend-
ment would limit cardrooms to the C-C and C-T zones and subject to a con-
ditional use permit.
4. Because of their nature, cardrooms are inappropriate in the other
commercial zones with the possible exception of the C-B zone. All of the
properties zoned C-B lie within the boundaries of the Third Avenue Rede-
. velopment Area and are subject to the regulations governing development
in the redevelopment area. The members of the Town Centre Business and
Professional Association have expressed their desire that cardrooms not
be permitted within the boundaries of the Third Avenue Redevelopment Area.

WHEREAS, Ordinance tio. 1738, adopted by the City Council on April 5, 1977,
established a limitation on the number of cardrooms to be permitted in the City
of Chula Vista, a limitaticn on the number of customers allowed at one time,
the hours of operation, and a restriction prohibiting persons 21 years of age or
under to play and the consumption� of any alcoholic beverage on site, and
4lHEREAS, Ordinance No. 1746, adopted by the City Council on May 10, 1977
as an interim ordinance and emergency measure for a period of 90 days, added
cardrooms as a conditi.onal use in the C-C and C-T zones, and
4JHEREAS, the City Council directed that the City Planning Commission
consider the adoption of a permanent ordinance to include cardrooms as a
- conditional use in the C-C and C-T zones, and . . .. . .
k'HEREAS, the City Planning Commission set the time and place for a hearing
to consider the proposed amendment to the Municipal Code, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. ,
June 22, 1977 in the Council Chamber, City Nall , 276 Fourth Avenue, before the
Planning Commission and said hearing was thereafter closed, and
WHEREAS, the Commission found that in "accordance with the Negative Declar-
ation on IS-77-41 and the findings stated therein, this project will have no
significant adverse environmental impact and certified that the Negative Declar-
ation �vas prepared in conformance with CEQA, 1970, as amended.
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
l . From facts presented to the Planning Commission, the Commission finds
that public necessity, convenience, general welfare and good zoning practice
require that Chapter•s 19.36 and 19.40 of the �+lunicipal Code be amended by adding
the following:

2. The Planning Commission recommends to the City Council that said

A. Project Description
The following amendments to the zoning text are proposed :
a. C-C zone - Section 19 . 36 . 030 Conditional Uses - be
amended by adding thereto a _ new subsection M to read :

b. C-T zone - Section 19 . 40 . 030 Conditional tises - be
amended by adding thereto a new subsection V to read:
V. Cardrooms .
' B. Analysis in Support of the Findings
Cardrooms are unclassified uses and defined as an amusement or a
recreational use which would be oermitted in any commercial zone '
subject to the approval of a' conditional use permit in accordance
with provisions of the Unclassified Use section of the Code . The
proposed zoning text amenclment would limit cardrooms to the C-C
and C-T zones and subject to a conditional use permit.
The conditional use process will insure aesthetic compatability with
adjacent uses, enforce landscaoe requirements and require adeguate
parking facilities to avoid 'disruption of traffic circulation
and �atterns. � -
A cardroom operating at allowed capacity (64 customers) £or the
maximum hours permitted- (12/hrs/day, 6 day/week) would consume an
estimated 15, 000 Kwh .hrs . of electricity and 480 therms of natural -
gas per year and 83 gallons o£ water per day. Based on a complete
trunover of clientel every 4 hours with two persons oer vehicle ,
about 200 vehicle trips/day could be anticipated.

D.' FZNDZNGS
1. The proposed z'oning text amendment involves no specific
property, therefore will not effect any physical resources.
2. The proposed project is not at variance with the long
term goals of the General Plan.
3. Restriction of the use to certain commercial zones will
limit the potential for cumulative effects on adjacent uses
and traffic circulation.
4 . There will be no direct or indirect adverse effect on
human beings as a result of the zoning text amendment.
