BACKGROUND � 1 . In April , 1976 the City Council adopted Resolution No. 8119 providing that_all development proposals on properties on both sides of Third Avenue between H and I Streets and on H Street between Third and Fourth Avenues would be reviewed by the Planning Cortmis- sion and City Council until the Third Avenue Project area boundary was established and the "P" Modifying District imposed upon the properties located outside of the Redevelopment Project area. The Redevelopment Agency Third Avenue Project Area has since been estab- lished (July 1976) and those properties lying within the Project Area boundaries are no longer affected by the resolution, whereas the properties along H Street are outside the boundaries and are still subject to the resolution. 2. This zone change has been initiated to permanently establish the "P" Precise Plan Modifying District on those properties lying outsi'de the Project Area boundaries and on H Street between Third and Fourth Avenues. 3. A Negative Declaration on this project was certified by the Plannin9 Corrunis_ `;sion on May 11 ,1977 and is herewith fo nvarded to the City Council . B. Discussion l . The City Council has already expressed its concern with the development and redevelopment of the properties located on .�oth sides of H Street between Third and Fourth Avenue in the vicinity of the South Bay Court complex by adopting Resolution ;8119 which requires Planning Commission and City Council review of deJelopment pro- posals on an interim basis. BOARD/COMMISSION RECOMMENDATION On ��1ay 11 , 1977 the Planning Commission voted 6-O to certify the Negative Declaration on IS-77-6 and to recommend that the City Council rescind Resolution No. 8119 and apply the "P" Precise Play Modifying District to those properties lying on both sides of H Street between Fourth Avenue arid the bnundary of the Third Avenue Project Area, with development or COUNCIL ACTION redevelopment of the property to be subject to 12 guidelines as enumerated in Resolution PCZ-77-E. All of the properties along H Street are zoned C-0 and the land uses from Fourth Avenue easterly to Third Avenue Project Area boundary are as follows : North side - Bank (Wells Fargo) South side - Bank (Imperial Savings) Professional offices Single family residence Apartments, 10 units Professional Offices Single family residence Apartments, 6 units Apartments , 28 units Apartments, 5 units 3. Of the ten properties on H Street, the two parcels developed with single family residences are the most likely to be redeveloped. The professional building on the south side of the street is a converted residential structure, which is also a possible candidate for redevelopment in the near future. The same can also be said of the two apartment sites developed with 5 and 6 units. The other two larger apartment complexes are in good condition and their redevelopment in the near fu- ture appears unlikely. 4. Copies of the staff report including the proposed guidelines were sent to each of the affected property owners along "H" Street prior to the Planning Corronis- sion hearing. No one spoke either in favor or against the proposal at the Plan- ning Comnission hearing. Five days after the Planning Commission hearing a letter was received from the property owner at 374 "H" Street indicating opposition to a 25' setback along "H" Street for two-story structures . C. Analysis Resolution #8119 was adopted as an interim measures to ensure that the properties would be developed or redeveloped in a manner which is harmonious and compatible with the South Bay Courts and consistent with the quidelines of the Third Avenue Design Manual . The guidelines recomnended in this report are consistent with the Third Avenue Design Manual and should result in projects which are harmonious and compatible with the court complex. The use of earthtone colors is preferred over the use of pastel colors. The use of building materials, such as wood, brick and textured block is encouraged. c. Pedestrian oriented areas shall be enhanced through the use af textured paving, benches, sculptures, and landscaping. d. . In no i�stance shall any structure be located closer to the front property line than allowed by the Building Line hWp of the City of Chuta Vista (established at 70 feet), except that structures or portions thereof that are greater than 15 feet in height shall maintain a setback of 25 feet or more frwn the front property line along H Street. e. Offstreet parking areas should be located either behind or to the side of the building. Parking in front of the building which extends across the width of the lot is discouraged unless the parking area maintains a 20 foot landscaped setback from the� front property line. f: All exterior elevations of the buildings visible from the street shail be architecturally treated'. . g. A71 exterior lighting shall be selected for its harnrony and compatibility with the architectural thene of the project. h. Signs are to be considered as part of the architecture and should therefore be considered and provided for during the early stages of design. i. No sign shall unreasonably obscure any existing signs on adjacent properties. The use of monument signs is preferred over freestanding pole signs. ! j. All roof equipment, including ducting, shall be architecturally screened as an integral part of the building design. , k. Any project approved through the precise plan procedure shall not be attered, added to, revised or changed in any manner (including exterior colors) unless approved by the Zoning Administrator who shall determine if the proposed request .is in keeping with the original approved project. The decision of the Zoning Administrator may be appealed to the Plannin9 • � . Comnission within ten days of the notification date. ; 7 � _z_ RESOLUTION N0. PCZ-77-E � � RESOLUTION OF THE CITY PLANNING COMt4ISSI0N RECOFiMENDING �TO . r�/ THE CITY COU�YCIL THE ATTACHMENT OF THE "P" PRECISE PLAN MODifYING DISTRICT TO PROPERTY ON BOTH SIDES OF H STREET BETWEEN FOURTH AVENUE AI:D THE SOUiHERLY BOUNDARY OF THE THIRD AVEt;UE PROJECT AREA WHEREAS, Resolution No. 8119, adopted by the City Council on April 6, 1976, provided that all development proposals on properties on both sides of Third Avenue between H and I Streets and on H Street between Third and Fourth � Avenues would be reviewed by the Planning Comnission and City Council until � the Third Avenue Project Area boundary was established and the "P" Modifying District imposed upon the properties located outside of the Redevelopment Project area, and WHEREAS, the boundaries of the Redevelopment Agency Third Avenue Project Area were established in July, 1976, and WHEREAS, the City Planning Cortunission initiated an application to estab- lish the "P" Precise Plan Modifying District to those properties on both sides of H Street between the Third Avenue Projx t Area boundary and Fourth Avenue, and WHEREAS, the Environmental Review Cortmittee conducted an Initial Study, _ IS-77-6, and concluded that there would be no significant adverse environmental impact as a result of this rezoning action, and on February 3, 1977 made a : draft Negative Declaration, and _ k'HEREAS, a public hearing was held at the time and place as advertised, r namely 7:00 p.m. , May 11 , 7977, before the Planning Comnission and said hearing was thereafter closed. - NOW THEREFORE BE IT RESOLVED AS FOLLOWS: ''' l. The Planning Co�mnission finds that in accordance with the Negative Declaration on IS-77-6 and the findings stated therein, this rezoning will have , _:: no significant adverse environmental impact and certifies the Negative Declaration. � 2. From facts presented to the Comnission, the Comnission finds that public necessity, convenience, general welfare and good zoning practice require - that the "P" Precise Plan Modifying District be attached to the zoning of those � properties lying on both sides of H Street between the Third Avenue Project Area and Fourth Avenue, with development or redevelopment of said properties to be subject to the following guidelines: - a. The architectural theme of any proposed development or redevelop- �� ment need not be identical to the design theme of the South Bay � ^ _ . _ . _. _. _,. . ' ' - ` — ` -- —' ----` _ , 1. Any significant changes shall require the submittal of a new precise ptan subject to the precise plan procedure. • 3. Findings of fact in support of attaching the "P" Precise Plan � Fbdifying District are as follows: a. Additional City regulation over developments occurring in •, this area is justified by virtue of the large sum of public money being•expended for public buildings in this imnediate area. b. . The size and configuration of some of the properties recomnended for inclusion in the "P" Modifying District is such that coordination of development ptans is necessary to enhance the safety and convenience of onsite circualtion and to protect the traffic carrying capacity of H Street. c. Good zoning practice dictates that the "P" Precise Plan Modifying District be attached to the properties to ensure that the development along H Street is harmonious and compatible with the South Bay Court canplex. d. The proposed guidelines are consistent with the Third Avenue Design Manual . ' e. The proposed guidelines are in corfiormance with the goals and objectives of the General Plan. 4. The Planning Comnission recomnends to the City Council that said change of zone be granted. 5. That this resolution be transmitted to the City Council and a copy sent to the owners of properties affected.
