HomeMy WebLinkAboutOrd 1978-1785 -� ORDINANCE NO. 1785 AN ORDINANCE OF THE CITY OF CHULA VISTA ADDING A NEW CHAPTER 2.67 TO THE CHULA VISTA MLTNICIPAL CODE REGULATING THE HOURS AND USE OF THE CHULA VISTA "J" STREET MARINA � The City Council of the City of Chula Vista does hereby ordain as follows: SECTION I : That a new Chapter 2. 67 be, and the same is hereby added to the Chula Vista Municipal Code to be, and to read � as follows : Chapter 2 . 67 REGULATION OF CHULA VISTA BOAT LAUNCHIP7G AND MARINA AREA - "J" STREET MARINA. Sec. 2 .67 . 010 Purpose and Intent. It is the purpose and intent of the City Council in establishing rules and regulations governing the use of the Chula Vista Boat Launching and Marina £acilities at the "J" Street Marina to insure the public in ; general, and the residents of this community in par- ticular, £ull and equal rights to the use and enjoyment of said public facilities without regard to the status or conditions of the users of said facilities. It is recognized that society generally has a right to use publicly owned premises in a sanitary and orderly con- dition and to £eel free and secure in the use thereof. It is the intent of the City Council in establishing these rules to protect the interests of the citizens in the enjoyment and safety of the public in the use of the facilities. Sec. 2. 67 .020 Presence Prohibited During Certain Hours - - Exceptions. It shall be unlawful for any person to enter or occupy any of the area of the Chula Vista Boat Launching and Marina facilities at the J Street Marina as the same is described on the attached map, marked Exhibit , "A" , attached hereto and incorporated herein by refer- ence as if set forth in full, for any purpose between the hours of 10 : 00-p.m. and 6 : 00 a.m. unless such person has written authorization from the Chief of Police or the Director of Parks and Recreation. 5., Sec. 2 . 67. 030 Posting. �, The Director of Public Works shall immediately � post the perimeter of the area described in this ordinance, with signs advising of the restrictions and limitations on the occupancy of said facility. -1- . ' SECTION II: This ordinance is an urgency ordinance necessary for the immediate preservation of the public peace, , health, or sa£ety as authorized by Section 311 of the Charter of the City of Chula Vista and shall go into immediate effect. Said urgency exists because of the numerous acts of violence and vandalism occuring at said facility during night time hours, said acts being committed by persons not occupying said facility for its intended purpose. � SECTION ZII: This ordinance shall become effective upon its first reading and adoption if passed by at least four (4) affirmative votes of the City Council as an interim ordinance and an emergency measure.
