AN ORDINAPICE OF THE CITY OF CHULA VIS'S'A AMEPIDING
SECTIONS 15. 32 . 010 THROUGH 15. 32 . 030, 15. 32 . 050
AND 15. 32 . 060 OF THE CHULA VISTA MiJT1ICIPAL CODE,
RELATING TO UNDERGROUNDING OF UTILITIES
The City Council of the City of Chula Vista does hereby
ordain as fellows :
SECTI02d I : That Sections 15. 32 . 010 through 15. 32 . 030,
15. 32 . 050 and 15. 32 . 060 of the Chula Vista Municipal Code be,
and the same are, hereby amended to read as folloo�s:
, Sec. 15. 32 . 010 Purpose and Intent of Provisions .
It is the purpose and intent of this division to
require the undergrounding of all future distribution
and transmission utility installations and all pre-
sently existing distribution and transmission installations
located within or adjacent to neca subdivisions in
�he the city, whether such subdivision has been created
by a subdivision map or a parcel map, except in those
circumstances where such undergrounding would be in-
feasible or impractical as set forth herein, It is
the intent of the city council to require that, hence-
forth, all new subdivisions shall be required to:
A. Provide for the undergrounding of distribution
facilities from the power source selected by the utility
company, even though such power source may be a substantial
distance from the boundaries of the proposed subdivision
or the distribution lines are located on common poles
with transmission lines and;
B. Provide for the undergrounding of independently
supported transmission facilities carrying sixty-nine
thousand volts or less in the same manner as for
distribution facilities.
Sec. 15. 32 . 020 Requirements - Generally.
All privately owned public distribution and independently
supported transr�ission utility systems within the bound-
aries of any subdivision and all such distribution uti- '
lity systems required to be constructed to any off-site
power source and service facilities within the boundaries
of any subdivision, shall henceforth be placed underground.
In addition, said owners or persons shall also be res-
ponsible for the undergrounding of a11 distribution
and all independently supported transmission facilities
which are adjacent to the property and located within
the public right-o£-way on that one-half of the public
right-of-way contiguous to the boundary of the subdivision
whenever the lineal footage of the electric distribution

, or the independently supported transmission facilities
to be converted within the subdivision and the lineal
footage of the electric distribution facilities to be
converted within the public right-of-way adjacent to
the subdivision equals or exceeds six hundred feet, or
at least one block, whichever is lesser for distribution
lines and one thousand f?ve hundred feet for independently
supported transmission lines. In the event that the
requirement of undergrounding existing distribution
utility systems adjacent to the boundary of a subdivision
as required herein should, in order to comply with the
utility's rules �and practices, necessitate the under-
grounding of other distribution utility systems and
service lines serving other property owners , the sub-
divider shall be responsible for such conversions
and each property owner is required to allow the nec-
essary changes to his premises to be made unless the
requirement is de£erred or suspended as provided in
Section 15. 32 . 040 . Transformers, terminal boxes, meter
cabinets , pedestals , concealed ducts and other facilities
necessarily appurtenant to such underground utilities
and street lighting systems may be placed above ground.
Sec. 15. 32 . 030 Responsibility of Subdivider.
. �'he subdivider shall be responsible for the requirements
of this division and shall make the necessary arrangements
with each of the public utility companies of the instal-
lation of underground facilities and the relocation of
existing facilities. The subdivider shall provide the
city with letters indicating that said arrangements
have been made with the public utility companies, stip-
ulating the undergrounding of said utility facilities
concurrent with the filing of the final map of any sub-
division as required by this chapter and the state Subdi-
vision Diap Act, and subject to the approval of the city.
Said arrangements between the subdivider and the public
utility companies as a condition of approval of the final
map may be waived as provided herein. �
A. The provisions of this section shall not require
the undergrounding of pocaer transmission lines of sixty
thousand volts or more located on common poles with
distribution lines.
B. Street lighting will be required as recommended
by the director of public works and approved by the
city council. . '
C. Television and radio reception shall be provided
, by means of a cable television system, franchised by
the city, or a master antenna television system, licensed
by the city pursuant to the provisions of Resolution
Pio. 6689 of Chula Vista, and the subdivider shall provide
the city with copies of the conditions, covenants. and
restrictions which shall indicate the prohibition of
' the use of individual outdoor antenna systems.

I� D. As used in this division, independently supported
- transmission facilities shall be defined as any 69KV or
lower -voltage transmission facilities- which do not share
' support facilities with distribution, communication,
community antenna television or similar or associated
services.
II. NEW STRUCTURES AidD CONVERSIONS
Sec. 15. 32 . 050 Requirements - Generally -
Responsibility of Owner - New
Structure or Building Defined.
A. All structures and buildings being constructed
and all existing structures and buildings being converted
from individual, corporate or partnership ownership of
multiple-family projects to condominium or other individual
; , unit form of ownership in any residential, commercial
or industrial zone in the city shall, within the exterior
boundary lines of such property, have all electrical,
communication, C.A.T.V. and similar distribution service
wires, and/or cables placed underground. The owner or
person converting any apartment building or project to
the condominium or other independent unit form of owner-
ship shall be responsible for cormplying with the require- '
ments of this division and shall make the necessarv
arrangements with each of the serving utilities £or the
installation of such facilities.
B. As used in this division, a new structure or
building shall be defined as one �ahere the building permit
valuation is twenty thousand dollars or more, and shall
also include additions , alterations and remodeling caork
to existing structures or buildings; provided, however,
that any additions, alterations or remodeling of existing
single-family dwelling units and new single-family .
dwellings constructed on existing individual lots shall
be exempted from the provisions of this chapter.
C. In addition, said owners or persons shall also
be responsible for . the unciergrounding of distribution
and independently supported transmission facilities
adjacent to the property and located in the right-of-way
as defined in Section 15 .32 . 020 of this chapter, when-
ever the lineal footage of the electric facilities to
be converted within the public right-of-way adjacent
to the conversion project equals or exceeds six hundred
feet or at least one block, whichever is lesser for
distribution lines and one thousand five hundred feet
for independently supported transmission lines.
D. In the event that the requirement of undergrounding
existing distribution utility systems adjacent to the
boundary of the conversion project as rPquired herein
should, in order to comply with the utility' s rules
and practices, necessitate the undergrounding of other

distribution utility systems and service lines serving
other property owners, the builder or converter, as
the case may� be , shall be responsible for such con-
versions and each property owner is required to allow
the necessary changes to his premises to be made unless
' the requirement is suspended or deferred as provided
in Section 15. 32 .070 . The provisions of this section
shall not require the undergrounding of power transmission
lines of sixty thousand volts or more located on common
poles with distribution lines. Transformers , .terminal
boxes, meter cabinets, pedestals , concealed ducts and
' other facilities necessarily appurtenant to such under-
ground utilities and street lighting systems may be
placed above ground.
E. As used in this division, independently supported
transmission facilities shall be defined as any 69KV or
' lower voltage transmission facilities which do not share
support facilities with distribution, communication,
community antenna television or sirmilar or associated
services.
Sec. 15. 32.060 Requirements - Above and Below
Ground Installations.
Transformers, terminal boxes , meter cabinets,
pedestals , concealed ducts and other facilities may.
be placed above ground. Water and sewer distribution
facilities shall be installed in conformance with
specifications of the director of. public works.
SECTION II : This ordinance shall take effect and be in
full force on the thirty-first day from and after its adoption.
