HomeMy WebLinkAboutOrd 1977-1779 ORDINANCE NO. 1779 AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING ZONING MAP OR MAPS ESTABLISHED BY SECTION 19 .18 .010 OF THE CHULA VISTA MUNICIPAL CODE , REZONING 1 . 18 ACRES ON THE SOUTHWEST SIDE OF OTAY LAKES ROAD FROM R-E TO C-C-P , AND CERTIFYING THE NEGATIVE DECLARATION WHEREAS, a notice of the proposed negative declaration on the rezoning of property located on the southwest side of Otay Lakes Road from R-E to C-C-P was given in accordance with the Environmental Review Policy, and S�HEREAS , the Environmental Review Committee found that said rezoning would have no possible significant impact on the environment and forwarded the attached Negative Declaration, IS-78-15 , to the City Council of the City of Chula Vista for their consideration, and wHEREAS , said Negative Declaration has been available to agencies having jurisdiction by law, all responsible agencies , and to the public for an adequate period of time for their review and comment, and WHEREAS , the information contained in said negative decla- ration has been considered by the City Council of the City of Chiila Vista prior to its action on the discretionary item befdre the City Council. NOW, THEREFORE , THE CITY COUNCIL of the City of Chula Vista finds as follows : 1 . That the City Council of the City of Chula Vista adopts as its record of this finding of no possible significant impact the - Council agenda statement on this agenda item and all of the attach- ments thereto . 2 . That the City Council of the City of Chula Vista finds in accordance with the recommendation of the Environmental Review Committee and the attached Negative Declaration that the proposed - rezoning will not have any possible significant impact on the en- vironment, and the attached Negative Declaration, incorporated herein by reference as if set forth fully, has been prepared in accordance with the California Environmental Quality Act of 1970 , as amended. 3 . That the Environmental� Review Coordinator is hereby authorized and directed to file said Negative Declaration with the County Clerk of the County of San Diego subsequent to the prepara- tion of a notice of determination on this project . NOW, THEREFORE , THE CITY COUNCIL of the City of Chula Vista does further find as the basis for the rezoning from R-E to C-C-P as follows : l . The supply of C-C-P zoned land in this area has diminished due to the fact that 6 acres in the C-C-P zone were developmed with multi-family units . 2 . The supply of vacant C-C-P land will be further diminished in that the commercial property at the corner of Otay Lakes Road and "H" Street has been acquired by a new developer who has expressed an intent to develop this land . - 1 - I3 .' The C-C-P zoning is appropriate and is compatible , with surrounding land uses in that the distance between the pro- posed C-C-P zone and neighboring apartments is sufficient to prevent any negative effects . The City Council of the City of Chula Vista does hereby ordain as follows : SECTION I : That the Zoning Map or Maps established by Section 19 .18 . 010 of the Chula Vista Municipal Code be hereby amended by adding thereto the following zoning changes : That that certain property consisting of approximately 1 .18 acres on the southwest side of Otay Lakes Road be , and the same is hereby rezoned from R-E to C-C-P pursuant to the provisions set forth in Section ' 19 .12 .020 governing the rezoning of property . � SECTION II : That any and all ordinances heretofore adopted by the City Council of the City of Chula Vista concerning zoning of said property be , and the same are hereby rescinded inso- far as the provisions therein conflict with this ordinance . ' SECTION III : This ordinance shall take effect and be in force on the thirty-first day from and after its passage and approval; provided , however , that said zoning shall not become � effective unless and until the property owner shall have dedicated the right of way required for the widening of Otay Lakes Road across the entire frontage of the parcel includinq that portion encumbered by the SDG&E easement, which dedication must occur within one (1) • year from the effective date of this ordinance , and should said dedication not be made within one (1) year of the effective date of this ordinance , this ordinance shall be null and void and have no force and effect.
