HomeMy WebLinkAboutOrd 1974-1563 . . : . . .. : y� . � : . . . .. . _.. � ORDINANCE NO. 1563 AN OP.DINANCE OF mHE CITY OF CHULA VISTA AMENDING SECTIONS 1 . 610, 1 . 611, 1. 619 , 1. 621 APID 1. 629 OF CHAPTER 1 OF THE CHULA VISTA CITY CODE RELATING TO THE CONTROL OF CHULA VISTA MUNICIPAL ELECTION CAMPAIGN CONTRIBUTIONS P.DID EXPEPIDITURES The City Council of the City of Chula Vista does ordain as folloo�s: SECTIOi•I Z : That Sections 1 . 610, 1 . 611, 1. 619 , 1. 621 and 1 . 629 of Chapter 1 of the Chula Vista City Code be, and the same are hereby amended to read as follows : Sec. 1 . 610, Campaign Statement Required. Each candidate and each committee shall file a cam- paign statement during each of the following periods : (a) Between the 20th and the 25th day preceding an election in which the candidate is seeking nonination � for or election to an office or in connection with which the comnittee or person has received contributions or made expenditures; (b) Between the 7th and the lOth day preceding such election; ' (c) Between the 30th and 35th day following such election, and (d) Every six months follocaing such election, so long as a candidate or committee has unpaid obligations , • whether legally enforceable or not, still outstanding, has unexpended balances of contributions totaling more than One Hundred Dollars ($100. 00) , or receives contri- butions during such period. Sec. 1 . 611. Canpaign Statement Contents. (a) Each campaign statement filed in accordance witti the terms of this ordinance shall contain the following information: � - (1) The cumulative total amount of all contributions and expenditures with respect to an election or elections held during the calendar year in which the statement is required to be filed, including but not limited to con- tributions and expenditures in aid or or in opposition to candidates or measures before they qualify for the ballot, contributions and expenditures following the election, and contributions and expenditures in the year preceding the calendar year in which the election or elections are held; (2) The full name and complete mailing address of any person from whom a contribution or contributions in the anount of Fifteen Dollars ($15) or more has been received, together orith the total amount con- tributed by each such person; - 1 - (3) The name, which in the case of an individual shall consist of the full nar.ie and complete mailing address of each person to whom an expenditure or expenditures have been made, together with the total amount paid to such person and a brief des- cription of the goods, services or facilities provided in consideration thereof; (4) The cunulative total anount of all expenditures for each candidate or measure supported or opposed for each election during the calendar year with respect to which expenditures have been made; and (5) The full name and complete mailing address of the candidate an� his caspaign treasurer, if filed by a candidate, and the full name and address of the comnittee and the full name and address of the committee ' s treasurer, if filed by a committee. (b) Where goods , materials , services , facilities or anything of value other than money is contributed or expended, the monetary value thereof shall be the fair market value; provided, however, it shall not be neces- sary to establish a monetary value for truly volunteer activities and the supplying of insignificant goods, materials, services and facilities of a de �inimus nature, e.g. , coffee and cake, and the use of a private home on behalf of a candidate would generally not be subject to these requirements. (c) Campaign statements shall include all infor- nation which is required by this section, but which has not been reported previously, for contributions and expenditures up to no more than three (3) days prior to the date of filing. Sec. 1. 619 . Campaign Contributions - Limitations. (a) No person other than a candidate shall make, and no campaign treasurer shall solicit or accept, any con- tribution that will cause the total amount contributed by such person with respect to a single election in :support of such candidate or in support of or opposition to a measure, including contributions to political committees supporting such candidate or supporting or opposing such measure, to exceed five percent (58) of the total amount of campaign expenditures allowable pursuant to Section 1. 623 . (b) No candidate shall make any contribution that will cause the total amount contributed by him to his campaign treasurer and all political committees sup- porting him to exceed with respect to a single election, five (5) times the limit specified in paragraph (a) of this section (twenty-five percent (25�) of the total amount of campaign expenditures as provided in Section 1. 623) . (c) If any person is found guilty of violating the terms of this section, each campaign treasurer who received part or all of the contribution or contributions which constitute the violation shall pay the amount received from such person to the Director of Finance, who shall place said monies in a special fund to be used to defray election costs of the next general municipal election. 3 � S'° � S'ec'. 1 .621. Anonymous Contributions . " ' Total anonymous contributions to a candidate or com- mittee which exceed in the aggregate One Hundred Dollars ($100. 00) with respect to a single election shall not be used by the candidate or committee for whom it was intended to the extent that total anonymous contributions exceed One Hundred Dollars ($100. 00) and the excess shall be paid promptly to the Director of Finance to be handled in accordance with Section 1. 619 . Sec. 1. 629 . Fair Election Committee: Created; Duties. There is hereby created a Fair Election Committee which shall consist of seven (7) members, being the members of the Board of Ethics of the City of Chula Vista as said Board may be constituted at the time the City Council may call any general or special municipal election. The Board of Ethics shall serve in the capacity of a Fair Election Committee for six (6) months following any such election. The Chairman of the Board of Ethics shall be responsible for calling the Committee together in order to carry out the duties set forth herein. The Fair Election Corunittee shall: (a) Enforce the provisions of this ordinance. (b) Cooperate with the City Clerk in preparing the design and content of appropriate forms for campaign statements and declarations required by this ordinance. (c) Cooperate with the City Clerk in the prepara- tion and publication of written instructions ex- plaining the duties of persons and committees under this ordinance. (d) Determine mhether required statements and declarations have been filed as required and, if so, whether they conform with the requirements of this ordinance. (e) The Fair Election Committee shall exercise extreme discretion in order to prevent unsubstan- tiated politically motivated charges from being publicly aired prior to an election. The Committee shall be subject to the same requirements and the filing of charges as the Board of Ethics is presently obligated. All charges must be in writing and signed, and no anonymous charges will be investigated as pro- vided herein. (f) The Fair Election Committee shall review this ordinance subsequent to each municipal election and make recommendations for amendments or modifica- tions to the City Council based upon the experience garnered from the administration of the ordinance in each election. SECTION II : This ordinance shall take effect and be in full force on the thirty-first day from and after its adoption. Presented and Approved as to Form by ��O'�sCi t .
