ORDINANCE NO. 1550
AN ORDINANCE OF THE CITY OF CHULA VISTA APLENDING
CHAPTER 1 OF THE CHULA VISTA CITY CODE BY ADDING
THERETO A NEW SECTION 1 .7 GRANTING A RIGHT OF
ENTRY TO AUTHORIZED CITY OFFICIALS FOR THE IN-
SPECTION OF BUILDINGS AND PRF.PIISES FOR THE
ENFORCEPflENT OF THE PROVISIONS OF THE CHULA VISTA
CITY CODE AND THE LAWS OF THE STATE OF CALIFORNIA,
AND REPEALING THE EXISTING SECTION 1,.7 OF SAID
CITY CODE
The City Council of the City of Chula Vista does ordain
as follows:
SECTION I : That Chapter 1 of the Chula Vista City Code
be, and the same is hereby amended by adding thereto a new Section
1 . 7 granting a right of entry to authorized City officials for the
inspection of buildings and premises for the enforcement of the
provisions of the Chula Vista City Code and the laws of the State
of California.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Chula Vista that Section 1.7 of Chapter 1 be , and the sane
is hereby amended to read as follo�as :
Sec. 1 .7 . Right of Entry - City Officials -
Enforcement of Chula Vista City Code.
Whenever necessary to make an inspection to enforce
any ordinance or resolution, or whenever there is rea-
sonable cause to believe there exists an ordinance or
resolution violation in any building or uoon any premises
within the jurisdiction of the City, any authorized
official of the City of Chula Vista, may, upon presenta-
tion of proper credentials, enter such building or
premises at all reasonable times to inspect the same
or to perform any duty imposed upon him by ordinance;
PROVIDED, that except in emergency situations or when
consent of the ocaner and/or occupant to the inspection
has been otherwise obtained, he shall give the owner
and/or occupant, if they can be located after reasonable
effort, twenty-four hours written notice of the authorized
official ' s intention to inspect. The notice transmitted
to the owner and/or occupant shall state that the property
owner has the right to refuse entry and that in the event
such entry is refused, inspection may be made only upon
issuance of a search caarrant by a duly authorized magistrate.
In the event the owner and/or occupant refuses entry after
such request has been made, the official is hereby em-
powered to seek assistance fror� any court of competent
jurisdiction in obtaining such entry.
SECTION II: That Section 1. 7 of the Chula Vista City
Code be , and the same is hereby repealed.
SECTION III : This ordinance shall take effect and be in
fu11 force on the thirty-first day from and after its adoption.
