ORDINANCE N0. 1548 AN ORDINANCE OF THE CITY OF CHULA VISTA �ENDIIQG I ZONING �IAP OR MAPS ESTABLISHED BY SECTION 33 .401 OF TIiE CHULA VISTA CITY CODE BY CF:ANGING THE ZONIPdG OF 18 PARCELS LYING IN TNE HILLSIDE area TO THE EAST OF I-805 The City Council of the City of Chula Vista does hereby ordain as follows: SECTIOiQ I : That the Zoning Map or Maps, established by Section 33 .401 of the Chula Vista City Code be hereby amended by adding thereto the following zoning changes: That those certain 18 parcels lying in the hillside area to the east of I-805 be, and the same are hereby rezonen in accordance with Planning Cor.unission Resolution Pdo . PCZ-74-A, adopted on the 24th day of April, 1974 , a copy of which resolution is attached hereto as Exhibit "A" and incorporated herein by reference as if set forth in fu11, pursuant to the provisions set forth in Section 33 .1201 governing the rezoning of property. SECTION II : That any and all ordinances heretofore adepted by the City Council of the City of Chula Vista concerning zoning of said property be, and the same are hereby repealed in- sofar as the provisions therein conflict with this ordinance. HHEREAS, on february 19, 1974 the City Council diretted that the Plarning Comnission consider the advisability of establishing the "H" Modifying District � to those areas east of I-805 that are zoned R-1, excluding those that are in the tentative map stage of proposed devetopment, and NHEREAS, the City Planning Cortmission approved Resotution EIR-74-2 adopti�ig an Environmental Impact Report on the application of the Hillside Modifying . District to large areas to the east of I-805, and . WFt�REAS, Resolution PCM-74-7, approved by the City Planning Comnission, . 1 recomnends the adoption of a Statenent of Overriding Considerations in the adoption � i � of Hillside Development Standards, and WNEREAS, the City Planning Cam�ission set the time and place for a public , hearing to consider rezoning various parcels east of I-805 by adding the "H" � Hillside and the "P" Precise Plan Ftodifying Districts, and notice of said hearing, � . The findings of fact in support of said determination are as follou�s: a. It is considered good zoning practice to preserve important geographic � . amenities, drainage courses, and the shape of urban development based on ' the framework of existing topography. ) b. It encourages .developers to utilize design criteria contained in the � � adopted Hillside Development Policy (adopted by Lity Council on � November 20, 1973, Resolution No. 7088). Application of these criteria . is intended to permit maximum possible intensity of develapnent within the context of enviromental management. e. It promotes preservation of natural hitlside areas as an inherent " . amenity of urbanization, as stated in the objectives of the Hillside ' Development Policy. � f. It reduces the intensity of urbanization to a level which can be � , . � properly served by the present capacity of the Lity of Chula VisW's ' _ � - purchased sewer system rights. g. The Planning Lomnission recomnends to the City Counci7 that said changes in zone designation be enacted. 4. The Planning Lortmission also recor,enends that the City Council, upon adopting , the recomnended rezonings, formally notify the County Assessor of the action taken; � the notite to include each parcel by assessor number, acreage, previous zoning, new zoning, and the maximum residential density and land grading allo�oed under the new zoning. 5. That this resolution be transmitted to the City Council.
