ORDINANCE NO. 1545
AN ORDINANCE OF THE CITY OF CHULA VISTA� CALIFORNIA, AMENDING SECTION 18A.1
AND ADDING NEW SECTIONS 18A.2, 18A.6 AND 18A.14 AND REPEALING SECTIONS 18A.2,
18A.3, 18A.4, 18A.5, 18A.6 AND 18A.13 OF CHAPTER 18 OF THE CHULA VISTA CITY
CODE, ALL RELATING TO THE ADOPTION OF THE UNIFORM BUILDING CODE, VOLUME II,
MECHANICAL, 1973 EDITION AND THE APPENDIX A, CHAPTER 22 OF B, AND C.
THE CZTY COUNCIL OF THE CITY OF CHULA VZSTA, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION I. That Section 18A.1 of Chapter 18 of the Chula Vista City Code be,
and the same is hereby amended to read as follows:
Section 18A.1. UNZFORM BUILDING CODE, VOLUME II, "MECHANICAL CODE", 1973 EDITION,
ADOPTED BY REFERENCE. There is hereby adopted by reference, that certain document
known and designated as the "Uniform Building Code, Volume II, Mechanical Code, 1973
Edition, Appendix A, Chapter 22 of B, and C, and the Uniform Mechanical Code Standards"
as copyrighted by the International Conference of Building Officials, three (3) copies
of which are on file in the office of the City Clerk. Said document is hereby adopted
as the Mechanical Code of the City, for providing for and regulating the complete in-
stallation and maintenance of heating, ventilating, cooling and refrigeration systems
in the City, providing for the issuance of permits therefor, and each and all such
regulations, provisions, penalties, conditions, and terms of the Uniform Building Code,
Volume II, Mechanical Code, 1973 Edition, Appendix A, Chapter 22 of B, and C and
Standards are hereby referred to, adopted, and made_part hereof as though fully set
forth herein, excepting such portions as are hereinafter deleted, modified or amended.
Section 18A.2. Section 303 (e) REINSPECTZON FEE. For each additional inspection
trip made necessary by reason of deficient or defective work, a fee of ten dollars
($10) may be required to be paid by the permittee.
SECTZON IZ. Section 18A.6. Section 1006 FZRE DAMPERS. See Uniform Building Code
Standard No. 43-7 and Chapter 43 of the Uniform Building Code, for the construction and
installation of duct openings in walls and ceilings. (U.B.C. Standard No. 43-7 is re-
printed in this Code.)
Accessibility for inspection and maintenance shall be provided with suitable
handhole openings with tightly fitted covers or doors. Such access shall meet require-
ments of construction of any fire resistive materials penetrated.
Section 18A.14. Section 1521 WATER COOLED UNITS. All water cooled refrigeration
units over 3/4 horsepower shall have a recirculating or evaporative type cooling system.

SECTION IZI.
Sections 18.A2, 18A.3, 18A.4, 18A.5, 18A.6 and 18.13 of Chapter 18 are
hereby repealed. .
SECTION IV. Any person violating any of the provisions of this Code or
the Oniform Building Code, Volume I2, Mechanical Code, 1973 Edition, shall be
deemed guilty of a misdemeanor and each person shall be deemed guilty of a
separate offense for each day or portion thereof during which any violation of
any of the provisions of such code or of this ordinance is committed, continued
or permitted and upon conviction of any such violation, shall be punishable by
a fine of not more than five hundred dollars ($500.00) or by imprisonment for
not more than six (6) months or by both such fine and imprisonment.
SECTION V. If any section, subsection, sentence, clause or phrase of this
ordinance of the Uniform Building Code, Volume II, Mechanical Code, 1973 Edition
is for any reason held to be unconstitutional, such decision shall not affect
the validity of the remaining' portions of this ordinance or the Uniform Building
Code, Volume II, Mechanical Code, 1973 Edition, and each section, subsection,
sentence, clause and phrase thereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared uncon-
stitutional.
SECTION V2. This ordinance shall take effect and be in force on the
thirty-first day from and after its passage and approval.

RESOLUTION OF THE CITY BOARD OF APPEALS RECOMMENDING TO CITY
COUNCZL THE ADOPTION OF THE UNZFORM BUILDING CODE, VOLUME II,
MECHANICAL, 1973 EDITION, AND THE APPENDIX A� CHAPTER 22 OF B�
AND C.
WHEREAS, due to rapidly changing heating and air conditioning
engineering and design, it is necessary to update the Mechanical Code, and
WHEREAS, the City Council of the City of Chula Vista passed
Resolution No. 5656 requiring the Director of Building and Housing to have
codes that are uniform with the other San Diego County jurisdictions, and
WHEREAS, The Board of Appeals set the time and place for a ,
hearing on said Code adoption, and notice of said hearing was given by the
publication in a newspaper of general circulation in the City at least ten
days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely,
Monday, May 13, 1974, before the Board of Appeals and said hearing was
thereafter closed,
NOW, THEREFORE� BE IT RESOLVED AS FOLIAWS:
l. From facts presented to the Board of Appeals, the Board
finds that public necessity, safety, convenience and general welfare require
the adoption of the 1973 Edition of the Uniform Building Code, Volume II,
Mechanical, and the Appendix A, Chapter 22 of B, and C.
2. The Board of Appeals recommends to the City Council that
said Uniform Building Code, Volume II, Mechanical, 1973 Edition, and the
Appendix A, Chapter 22 of B, and C, be adopted.
PASSED AND APPROVED BY THE BOARD OF APPEALS OF CHULA VISTA, CALIFORNIA, the
13th day of May, 1974, by the following vote, to-wit:
