CITY OF CHULA VISTA Ab1EPIDIPdG SECTIOIV 27 .303 OF AR^ICLE 3 OF CHAPTER 27 OF THE CFIULA VISTA CITY CODE RE?,ATING TO ThOSE EiICROACFI- L•1ENTS IN THE PUBLIC•�RIGHT-OF-S�7AY EXEt4PT FROM FEE REC,�UIREIrt.E�ITS " The City Council of the City of Chula Vista does ordain as follows : SECTION I : That Section 27 . 303 of Article 3 of Chapter 27 of the Chula Vista City Code be, and the sarie is hereby anended to read as follows : Sec. 27 . 303. Encroachments Authorized by Director of�c Works. A. Fee Requirements. The Director of Public S��orks is hereby authorized to issue encroachnent pernits with- out prior authorizatior. from the City Council for the installation of the following irprover.!ents: 1 . Fences in accordance e�ith zoning and building codes. 2 . Retaining walls in accordance with zon?ng and buildina codes, not to exceed five feet (5 ' ) in heigtit. 3 . Private utility service, including telephone, gas and electric, cable television and private lighting systen. 4 . In addition thereto, the Director of Public i4orks may permit temporary encroachnents in the public right- of-way upon application for an encroac:ur.ent pernit and the paynent of the fee as prescribed in Section 27 . 207 of this chapter for the placinq of naterials or equio- ment in the public right-of-���ay, for a period not to exceed ninety (90) days , provide� that said materials are of such a nature' as to be easily removable and cause no obstruction to the free passage of vehicular and pedestrian traffic along the public right-of-way, and said encroachment is necessitated by the applicant' s construction or developMent of his property. A11� other encroachnents in the public right-of-way of any nature other than those defined as exenpt or as ter.iporary shall constitute permanent encroachnents for which perr.iits may be issued and fees collected as prescribed in this chapter. The issuar.ce of said per- mits by the Director of Public Wor}:s shall conforn with the rea,uirements of this art?cle. B. Eneroachments Not Sub�ect to Fee Requirements. Encroachnents in the public right-of-��ay for the in- stallation oi sprinY.ling systems and mail boxes, as required by the Postal Service, shall be exempted froat fee requirenents as set forth in Section 27 .305 pro- vided that said installation shall be subject to the execution of an Encroach_ment A4aintenance and Renoval Agreenent. SECTION II : This ordinance shall take effect and be in full force on the thirty-£irst day fron and after its passage and approval.
