AN ORDINANCE OF THE CITY OF CHULA VISTA PROPOSZNG
AND SUBMITTZNG TO THE ELECTORS OF SAID CITY AT THE
GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY
ON' THE 9th DAY OF APRIL, 1974 , CERTAIN PROPOSITIONS
TO ADOPT AN ORDINANCE, AND TO AMEND THE CHARTER OF
THE CITY OF CHULA VISTA
The City Council of the City of Chula Vista does ordain
as follows : '
SECTION I : Pursuant to the provisions of Section Eight
of Article Eleven of the Constitution of the State of California,
and' the Elections Code of the State of California, the City Council
of the City of Chula Vista, being the legislative body thereof, hereby
proposes and submits to the gualified voters of said City at the gen-
eral municipal election to be held on the 9th day of April, 1974 , the
propositions contained in Exhibit "A" attached hereto and made a part
hereof by this reference, to adopt an ordinance and amend the Charter
of said City. '
SECTION II : The method of voting upon said Charter provi-
sions shall be as provided in the Elections Code of the State of
California, and on the ballots to be used at said general municipal
election, in addition to any other matters required by law, there
shall be printed substantially the language contained in Exhibit "B" ,
attached hereto and by reference made a part hereof .
SECTION IZI : Said propositions shall be designated on the
ballots by letters printed on the left margin of the square containing
the description of the measure, as provided in Section 10231 of the
ETections Code of the State of California . Only qualified voters of
the City of Chula Vista shall be permitted to vote at said election.
SECTION IV: The City Clerk of the City of Chula Vista shall,
within fifteen (15) days after its final passage, cause this ordinance
to be published once in a newspaper of general circulation in the City
of Chula Vista . No' other notice of such election need be given.
SECTION V: This ordinance shall take effect and be in force
from and after its passage.

EXHIBIT "A"
PROPOSITION A
An amendment to the Charter of the City of Chula Vista amending
Article III, Section 300 by assigning numbered seats to each
Council position to be selected by lot.
Sec : 300 . Members and Terms.
(Paragraphs 5, 6 and 7 to be added)
Each Councilman shall be assigned a numbered seat to be selected
by lot. Said- seats shall be numbered 1 through 4 respectively and
any person seeking election to the City Council shall at the time
of filing his nomination papers, select one of said seats as the
Council position for which he seeks election. •
Said election process by numbered Council seats shall commence
at the general municipal election to be conducted in April of 1976,
and all persons running for a Councilmanic office shall designate
one of the two numbered Councilmanic seats as selected by lot and
memorialized by resolution of the City Council of the City of Chula
Vista on file in the office of the City Clerk. Should a vacancy
occur at any time in a Councilmanic seat or seats; if said vacancy
is to be filled by a special election as provided in Section 303
of the Charter, candidates for said vacancy shall similarly desig-
nate the appropriate numbered seat on their nominating papers.
In order for any person to be elected for any numbered
Council seat 1 through 4 or the office of Mayor for which he has
filed his nomination papers,- he must receive a . majority of all
votes cast for said Council seat or the office of Dlayor, and if,
and in the event that no candidate for such numbered Council seat
or office of Mayor, receives a majority of the votes cast, the two
candidates receiving the highest number of votes for said seat shall
run in a special runoff election to be conducted on the second Tues-
day in June following the general municipal election on the second
Tuesday in April in even numbered years, and in the case of the
office of Mayor, a special election shall be scheduled for the
seconiiTuesday in June following the general municipal election
on the second Tuesday in April conducted for the purpose of
electing the Mayor. '
PROPOSZTION B
Amend Article XI, Section 1106 thereof, of the Charter of the City
of Chula Vista to be, and to read as follows :
Sec. 1106 . Tax Limits.
(a) Property Taxes. The City Council shall not levy a property
tax, for municipal purposes, in excess of one dollar and eighty cents
($1. 80) annually on each one hundred dollars of the assessed value of
taxable property in the City, except as otherwise provided in this
Section, unless authorized by the affirmative votes of a majority of
the electors voting on a proposition to increase such levy at any
election at which the question of such additional levy for municipal
purposes is submitted to the electors. The number of years that such
additional levy is to be made shall be specified in such proposition. �

EXHIBIT "A"
(b) Additional Taxes. There shall be levied and collected
at the time and in the same manner as other property taxes for
municipal purposes are levied and collected, as additional
taxes, if no other provision for payment thereof is made :
1. A tax sufficient to meet all liabilities of the
City for principal and interest of all bonds or judgments
due and unpaid, or to become due during the ensuing fiscal
year, which constitute general obligations of the City; and
2. A tax sufficient to meet all obligations of the
City to the State Employees ' Retirement System for the
retirement of City employees , due and unpaid or to become
due during the ensuing fiscal year.
PROPOSITZON C
Amend Article VI, Section 605 thereof, of the Charter of the
City of Chula Vista to be, and to read as follows :
Sec. 605 . Compensation. Vacancies.
The members of boards and commissions shall serve without
compensation for their services as such, but may receive reim-
bursement for necessary traveling and other expenses incurred
on official duty when such expenditures have received authori-
ation by the City Council; provided, however, that members of
the Planning Commission shall receive in addition as compen-
sation for their services the sum of TWENTY DOLLARS ($20 . 00)
per meeting, which sum shall not exceed a tota�l 6f SIXTY
DOLLARS ($60 . 00) per month.
Any vacancies in any board or commission, from whatever
cause arising, shall be filled by appointment by the City Coun-
cil. Upon a vacancy occurring leaving an unexpired portion of
a term, any appointment to fill such vacancy shall be for the
unexpired portion of 'such term. Zf a member of a board or
commission absents himself from three regular meetings of such
board or commission, consecutively, unless by permission of
such board or commission expressed in its official minutes , or
is convicted of a crime involving moral turpitude , as deter-
mined by a court of competent jurisdiction, or ceases to be
a qualified elector of the City, his office shall become vacant
and shall be so declared by the City Council.

EXHZBIT "B"
PROPOSITION A
An amendment to the Charter of the City of Chula
Vista amending Article III , Section 300 thereof ,
providing for the numbering of the seats for the
office of City Councilman so that each Council
seat shall be designated as Council seat 1 through YES
4 respectively. It is further provided that in
the event any candidate for either a Councilmanic
seat or the Mayoralty shall not have received a
majority of the votes cast in the general munici-
pal election, a runoff election shall be conducted
between the two candidates receiving the highest
number of votes for any Councilmanic seat to be NO
held on the second Tuesday in June following the
general municipal election in even numbered years ,
or for• the Mayor on said date in the odd numbered
years when the election is held for the office of

PROPOSZTION B
An amendment to the Charter of the City of C ula
Vista amending Article XI , Section 1106 thereof, YES
eliminating the separate levies for the Library,
Parks and Recreation and Planning and combine
said levies with the general levy for municipal
purposes, but retaining the same maximum overall NO
limitation of $1. 80 tax rate on each $100. 00 of
assessed valuation.
PROPOSITION C
An Amendment to the Charter o t e City of C u a

providing for the establishment of compensation
for members of the •.Planning Commission in an -
amount=of $20 ..00 per meeting and not to exceed NO
