HomeMy WebLinkAboutOrd 1973-1510 ORDINANCE NO. 1510 • � AN ORDINANCE OF THE CITY OF CHULA VISTA, AMENDING SUBSECTION 1 OF SECTION 27 . 214 , SECTION 27. 308 AND SECTION 27. 411 OF THE CHULA VISTA CITY CODE, RELATING TO LIABILITY INSURANCE COVERAGE ON WORK IN THE PUBLIC RIGHTS-OF-WAY The City Council of the City of Chula Vista does ordain as follows: SECTION I : That Subsection I of Section 27. 214 of tlie Chula Vista City Code be, and is amended to read as follows : Section 27. 214 . Application for Permit; Insurance Required. 1. Applicant has provided the Director of Public Works with a policy of insurance which has been approved by the City Attorney, executed and delivered by a reliable insur- ance company authorized to carry on an insurance business in the State of California, by the terms of which said insurance company assumes responsibility for injuries to persons and property as a result of moving the vehicle or load by permittee, in the following amounts, to-wit: One Hundred Thousand Dollars ($100 , 000 . 00) for property damage; Two Hundred Thousand Dollars ($200, 000 . 00) for death or injury to any person in any one occurrence; Five Hundred Thousand Dollars ($500 , 000. 00) for death or injuries to two or more persons in any one occurrence. Governmental agencies, including the State of California and its political subdivisions , shall not be reguired to provide the insurance required by this section, but shall be required to hold the City harmless as hereinafter pro- vided. SECTION II : That new section number 27 . 308 of the Chula Vista City Code be and is amended to read as follows: Section 27. 308. Insurance Required. The Director of Public Works may require submission of insurance which has been approved by the City Attorney, executed and delivered by a reliable insurance company authorized to carry on an insurance business in the .State � of California, by the terms of which said insurance company assumes responsibility for injuries to persons and property as a result of constructing the work and/or storing materials in the street as set forth in the permit. The insurance, when reguired, shall be in the following amounts : One Hundred Thousand Dollars ($100 , 000. 00) for property damage; Two Hundred Thousand Dollars ($200 , 000 . 00) for death or injuries to any person in any one occurrence; Five Hundred Thousand Dollars ($500 , 000. 00) for death or injuries to two or more persons in any one occurrence. _ , _ . . Governmental agencies, including the State of California and its political subdivisions, shall not be required to provide the insurance required by this section, but shall be required to hold the City harmless. ' Any permittee for whom insurance requirements have been waived shall be required to hold harmless and defend the City of Chula Vista, its elective and appointive boards, officers, agents and employees from any liability for damage or claims for damage for personal injury, including death, as well as from claims which may arise from permittee, or any sub-contractors or agents or employees thereof in performing under the permit. SECTION III . That Section 27. 411 of the Chula Vista City Code be and is amended to read as follows: Section 27. 411. Insurance Required: Prior to issuance of a public works construction permit, the applicant shall have provided the Director of Public Works with a policy of insurance which has been approved by the City Attorney, executed and delivered by a reliable insurance company authorized to carry on an insurance business in the State of California, by the terms of which said insurance company assumes responsibility for injuries to persons and property as a result of constructing the work set forth in the permit, in the following amounts : One Hundred Thousand Dollars ($100, 000 . 00) for property damage; Two Hundred Thousand Dollars ($200, 000. 00) for death or injuries to any person, in any one occurrence; Five Hundred Thousand Dollars ($500 , 000. 00) for death or injuries to two or more persons in any one occurrence. Governmental agencies , including the State of California and its political subdivisions, shall not be required to provide the insurance required by this section, but shall be required to hold the City harmless .
