HomeMy WebLinkAboutReso 1994-17533 RESOLUTION NO. 17533 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING THE CITY OF CHULA VISTA AMERICANS WITH DISABILITY ACT (ADA) COMPLIANCE PROGRAM AND GRIEVANCE PROCEDURE WHEREAS, Council. at its workshop on January 28, 1994, considered the City's Americans with Disability Act Compliance Program and directed staff to solicit additional public comments on the City's ADA compliance efforts and incorporate such comments into the compliance program; and, WHEREAS, staff has held two additional public meetings for this purpose, and is now presenting this plan to Council for adoption; and, WHEREAS, the Human Resources Commission at its February 10, 1993 meeting unanimously endorsed staff's proposed on-site and street related ADA compliance program. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby adopt the City of Chula Vista Americans with Disabilities Act (ADA) Transition Plan for on and off-site City facilities as set forth in Appendix A, attached hereto and incorporated herein by reference as if set forth in full. BE IT FURTHER RESOLVED that the City Council does hereby adopt the Grievance Procedure for the American with Disabilities Act, as set forth in Appendix B, attached hereto and incorporated herein by reference as if set forth in full. Appendix A addresses required on-site public fadliLt modifications and Appendix C identifies all locations required to be modified to provide wheelchair accessible curb ramps. The Plan is intended to ftd~ll the requriements of Title II, Section 35,150 of the Americans with Disabilities Act, which reqtfires local govemTnents to ensure that all programs, services, and activities are readily accessible and usable by individuals with disabilities. The City has evaluated all facilities which it owns, operates, or provides setwices. programs, and activities, and developed a complete listing of all modifications needed to ensure accessibility and the schedule for completion of each modification. While this effort is required under the ADA. it may also be used as evidence of the City's leadership status in terms of local government ADA compliance and our commitment to serving all members of the Chula Vista community. The plan will be used to implement physical tnodifications to existing on-site city owned radiities or the location at which the city offers programs or services. Each modification has been identified on the following pages by Project Year, Funding Source, City' Department using fadliLt, Location of fadlity, type of modification, and estimated cost of the modification. Tbe "Project Year" is that in which the modification will be implemented (1994 - FY 93/94:1995 - FY 94/95:1996 - FY 95/96). The proposed "Funding Source" indicates the anticipated source of funding for the mndi~cation, or the Department or organization which has the responsibility for fimding tbe modification. Tbe funding source abbreviations shown in each section are as follows: AMR LEG American Legion (No city funds proposed) B&GCLUB Boys and Girls Club (No city funds proposed) YMCA YMCA of Cbula Vista (No city funds proposed) PDCIP Police Department Capital Improvement Program (CIP) PRCIP Parks and Recreation Department CIP CDBG Community Development Block Grant The first column in each funding source group indicates the department(s) or organization which uses the. fadlity to provide a serjice, program, or activity. followed by the facility to be modified. The~proposed modification to ADA Accessibility Guidelines aad California Accessibility requirements (with the most stringent to be implemented) has been listed in the third column, with an estimated cost forimplementation shown in the last column. Full descriptions of the specific modification and installation specifications have been completed, but not included in this document, and are available upon request. L: S ~59,570 Resolution No. 17533 Page 13 APPENDIX B City of Cbula Vista Americans witl~ Disabilities Act Public Griewmce Policy POLICY STATEMENT It is the policy of the City of Chula Vista to prohibit discxmfination based ou disability. The public has an equal fight to access all facilities, programs, empluyment upportunities and services the City of Chula Vista provides for public use. GENERAL DISCRIMINATION Discrimination is defined as the act of "making a distinctilm ill lavor of or against a person on the basis of the group, class or category to which the person belongs. lather than according to the person's actual merit." These behavior may be unintentionally directed at a nlembei ill the pnblic. by the presence of barriers (physical or otherwise) that impede an individual's attainment of employment or the utilization of a service or program offered by the City, based on a disability ciphered under tile Alnericans With Disabilities Act of 1990 (ADA). (1) Discrimination in Employment: "No eml>luye~ covered under the ADA shall discriminate against a qualified individual with a clisability because of the disability . . . in regard to job application procedures, employee compensation. job training and other terms, conditions and privileges of employment" (42 t!.S.C, 12112L The City of Chula Vista must make "reasonable accommodations" tu the knllwn physical or mental impairments of otherwise qualified individuals unless the resuh would el eate all "ondue bardship" on the City. based on the legal interpretation of these terms. (2) Discrimination in the distributioa uf public sei',rices in Chula Vista: The ADA states that" . · . no qualified individual with a disability shall, by reason of such disability, be excluded from participation in or be denied tile benefits uf the services, programs, or activities of a public entity, or be subjected to discrimination by any such public entity" (42 U.S.C. 12132). The City of Chula Vista must ellstile that all p~ograms, facilities and services that are offered to the public are free fronl ban'iers that would impede the utilization of such programs, fadlilies and selwices by individuals with disabilities. GRIEVANCE PROCESS 1. A job applicant, or member of the public whl~ bclicves they bave been discriminated against on the basis of disability by the City of Cbula Vista may nlake a written complaint as soon as possible after the incident to the compliance officer CRisk Manager, Personnel Department, 276 Fourth Avenue, Chula Vista, 91910). The Compliance Officer has been designated by the City of Chula Vista to coordinate the City's efforts to comply with Federal aod Strife laws concernlug discrimination in the areas of employment, public sel~/ices, progranls ,r activities tbat discriminate on the basis of disability. .........
