COMMENCING ON AUGUST 42, 1980 � .
By a unanimous vote of the City Council on August 12, 1980,
the :interim ordinance was placed on first reading and .
adopted. It establishes �a 90-day moratorium on the
� � approval of t�t���eed maps required as a condition to the •
� conversion o�' apa tment rental units to condominiums
' commencing August 12, 1980 pending an in-depth study �
of the problem by the Planning staff and Planning
Commission. The moratbrium will remain in full'force
and effact to and until November 12, 1980 or until such
time as the City Council adopts new condominium conversion�"�`�i
regulations or reaffirms existing regulations to be continued�"�— �

ORDINANCE NO. 1918
AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CHULA VISTA ADOPTING AN URGENCY NIEASURE DECLARING
A MORATORIUM ON THE CONVERSION OF OCCUPZED APARTNIENT
UNITS TO CONDOMINIUM OL4NERSHIP FOR A PERIOD OF NINETY
DAYS COMMENCING ON AUGUST 12, 1980
The City Council of the City of Chula Vista hereby finds
and determines as follows :
1 . The nearly zero vacancy factor in apartment rental
units in the City of Chula Vista has created an inability on the
part of the housing market to satisfy the needs of a great many
families and individuals to find decent rental housing and who
are unable to purchase housing .
2 . There are apparently significant numbers of condo-
minium units available for sale and/or rental at prices substantially
in excess of the financial capability of low and moderate income
families .
3 . The exact market conditions relative to the number
of condominiums versus apartment rental units is unknown at the
present time and requires substantial in-depth study both as to
market availability and social impact of continuing condominium
conversions . �
4 . Such studies are required to enable approoriate
recommendations to be made for modification, if any are determined
necessary in our existing ordinance regulating condominium conver-
sions .
5 . There is an urgent necessity to temporarily stabilize
the condition of apartment rental units by placing a moratorium on
their conversion to condominiums .
NOW, THEREFORE, the City Council of the City of Chula Vista
ordains as follows :
SECTION I . Purpose and Intent.
It is the purpose and intent of the City Council to
establish a ninety (90) day moratorium on the approval
of tentative maps required as a condition to the con-
version of occupied apartment rental units to condo-
miniums commencing August 12, 1980 pending an in-depth
study of the problem by the Planning staff and Planning
Commission .
SECTION II . Moratorium Established .
The City Council does hereby establish a moratorium
on the submission of tentative maps for approval by
the City Council , and upon the filing of any applica-
tions for the conversion of occupied apartments to
condominiums , processing of such applications including
the processing of ten£ative maps and any further action
by either the Planning Commission or City Council on
tentative maps which have been submitted .

Said moratorium shall not apply to condominium conversion
situations where the tentative map has been approved by
the City Council .
The moratorium shall remain in full force and effect to
and until November 12, 1980 or until such time as the
City Council adopts new condominium conversion regulations
or reaffirms existing regulations to be continued without
modification, whichever occurs first in time .
SECTION III . Severability .
If any provision or clause of this ordinance or the appli-
cation thereof to any person or circumstance is held to
be unconstitutional or to be otherwise invalid by any
court of competent jurisdiction, such invalidity shall
not affect other ordinance provisions or clauses or
applications thereof which can be implemented without
the invalid provision or clause or application and to
this end the provisions and clauses of this ordinance
are declared to be severable .
SECTION IV. Urgency Measure . .
This ordinance is hereby declared to be an interim ordi-
nance adopted as an urgency measure to protect the public
health, safety and welfare and shall take effect immediately
upon its adoption. The facts constituting such urgency
are set forth hereinabove and represent a serious threat
to the maintenance of existing property rental supplies
within the city for the availability of all economic
segments of the community and especially to persons of
low and moderate incomes and to those on fixed incomes,
which are hereby declared to be contrary to the ge.nerally
stated goals and objectives of the Housing Element of the
General Plan of the City of Chula Vista .
This ordinance shall become effective upon its first
reading and adoption if passed by at least four (4)
affirmative votes of the City Council as an interim
ordinance and an emergency measure .
