By a unanimous vote of the City Council on April 1, 1980, ,
. the ordinance was placed on second reading •and adopted. � '
The' property consists of two parcels :of approximately .6 �
acre, .located on the south side of "D" Street, 90 feet east
' of- Broadway. :In accordance to Planning Commission .Resolution
. No. �PCZ-80-B, .the property was. rezoned from R-3 to C-T-P
subject to (i) orientating, the development as much'as possible
- toward Broadway; (2) maintaining: two access driveways off
"D" Street; and (3) constructing a �6' high zoning wall adjacent
. to the R-3 zone. The Negative Declaration, IS-80-33,
. submitted the finding of no significanf impact upon the �

ORDINANCE NO. 1905
AN ORDZNANCE OF THE CITY OF CAULA VZSTA AMENDING
ZONING MAP OR MAPS ESTABLISHED BY SECTION 19 .18 .010
OF THE CHULA VISTA MUNICIPAI, CODE REZONING .6 ACRE
ON THE SOUTH SIDE OF "D" STREET EAST OF BROADWAY
FROM R-3 TO C-T-P .
The City Council of the City of Chula Vista finds as
follows :
' That in accordance with the attached Negative Declaration,
IS-80-33 and the findings therein, the proposed rezoning will not
have a significant impact upon the environment, and the City Coun-
cil hereby certifies that the Negative Declaration was prepared
in accordance with the California Environmental Quality Act of
1970, as amended .
The City Council of the City of Chula Vista does hereby
ordain as follows :
SECTION I : That the Zoning Map or Maps established by
Section 19 .18 .010 of the Chula Vista b7unicipal Code be hereby
� amended by adding thereto the following zoning changes :
That that certain ro ert � '
p p y, consisting of two parcels,
approximately .6 acres, located on the south side of "D" Street,
90 feet east of Broadway, be, and the same is hereby rezoned from
R-3 to C-T-P in accordance with Planning Commission Resolution
No . PCZ-80-II, adopted on the 13th day of February, 1980, with
paragraphs 2 .b, 2 .c and 2 .e Modified to read as follows, pursuant
to the provisions set forth in Section 19 .12 .020 governing the
rezoning of property:
2 .b All development shall be oriented as much
as possible toward Broadway and shall be designed
so as to minimize access from "D" Street . The ,
recently widened drive-through from Broadway shall
be maintained and used as much as possible for
access to the subject property for employees and
smaller vehicles .
2 .c Two access driveways to "D" Street may be main-
tained on the subject property, one of which shall
be widened in accordance with engineering require-
ments . The third curb cut adjacent to the residential
property to the east shall be removed and the curb
restored . Street improvemerits and landscaping shall
be installed in accordance with city standards .
2 .e A zoning wall (minimum 6 ' height) shall be
constructed adjacent to the R-3 zone and landscape
screening (trees) as approved by the City, shall be
_ planted within 90 days after the zoning becomes
final . The portion of the zoning wall along the
south property line (adjacent to the vacant area)
may be deferred until the vacant area is developed . �
The wall shall be carried along the entire "D"
Street frontage of the property being rezoned
except for the gate area : :

SECTION ZI : That any and all ordinances heretofore
adopted by the City Council of the City of Chula Vista concerning
zoning of said property be, and the same are hereby, rescinded
insofar as the provisions ti-ierein conflict with this ordinance .

SECTION III: This ordinance shall take effect and be
in full force on the thirty-first day from and after its passage
and approval.
