HomeMy WebLinkAboutOrd 1979-1869 ORDINANCE N0. 1869 (Synopsis) AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING CHAPTERS 19.54 AND 19.58 OF THE CHULA VISTA MUNICIPAL CODE TO ALLOtJ SENIOR CITIZENS' HOUSING DEVELOPMENTS AS CONDI- TIONAL USES AND PROVIDE FOR MODIFICATIONS TO THE NORMAL REQUIREMENTS Of THE ZONING ORDINANCE FOR SUCH DEVELOPMENTS The interim ordinance provides that senior citizens' housing developments are now to be considered by the conditional use permit process which will allow for exceptions to density, off- street parking, minimum unit size, open space and other require- ments. During the period the interim ordinance is in effect, which is 90 days, all applications will be processed both by the Flanning Cortunission and City Council . I �� � �G� • • revised 5/23/?9 � ORDINANCE NO. 1869 AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING CHAPTERS 19 . 54 AND 19 .58 OF THE CHULA VISTA MUNICIPAL CODE TO ALLOW SENIOR CITIZENS ' HOUSZNG DEVELOPMENTS AS CONDI- TIONAL USES AND PROVIDE FOR MODIFICATIONS TO THE NORM7IL REQUIREMENTS OF THE ZONING ORDINANCE FOR SUCH DEVELOPMENTS The City Council of the City of Chula Vista does ordain as follows : SECTION I : That Section 19. 54 . 020 of the Chula Vista Municipal Code be, and the same is hereby amended to add a new subsection "P" to read as follows : Sec. 19: 54 . 020 • Designated - Limitations- and . standards . (Add subsection "P" ) P. Senior citizens ' housing developments. (See Section 19. 58 .390) . SECTION II : That Section 19 . 58 .390 be , and the same is hereby added to the Chula Vista Municipal Code to read as follows : Sec. 19. 58 . 390 Senior citizens ' housing developments . Pursuant to Section 19. 54 .020, housing developments for senior citizens may be allowed in any zone except the R-1, R-2 and industrial zones. Because the resi- - dents of such developments have characteristics which differ £rom those of families and younger persons, it is not appropriate to apply all of the normal zoning standards to such dev,elopments. Accordingly, pursuant to the processing of a conditional use permit for such developments , as required by Section 19. 54 . 020 P, the Planning Commission may make exceptions to the density, offstreet parking, minimum unit size, open space, and such other requirements as may be appropriate. The Planning Commission may also adjust required setbacks , building height, and yard areas as appropriate to provide an adequate living environment both within the develop- ment and on nearby properties. Any exceptions and adjustments shall be subject to the condition that the development will be available for occupancy by senior citizens only; provided, further that during the effec- tive term of this ordinance, as an interim ordinance, all applications shall be subject to review and approval of both the Planning Commission and the City Council. SECTION III : This ordinance shall become effective upon its first reading and adoption if passed by at least four (4) affirmative votes of the City Council as an interim ordinance and an emergency measure.
