HomeMy WebLinkAboutReso 2014-062 RESOLUTION IvO. 2014-062 RESOLUTION OF THE CITl' COUI�'CIL OF THE CITI' OF CHULA VISTA APPROVII�'G A LEGAL SERVICES AGREEA4EI`TT BETI�%EEN THE CITY OF CHULA VISTA AI�iD THE THOA4AS LAN' GROUP FOR ATTORI�TEY SERVICES RELATED TO THE PREPARATION OF LAND USE IMPLEMENTATION AND ENVIRONMENTAL DOCUMEI�'TS FOR THE UI�'IVERSTY PARK A1�TD II�TNO�'ATIOt�' DISTR]CT WHEREAS; in 2008, the Cit}� entered into Land Offer Aereements (LOAs) that ���ill provide appro�imatel}� 37� acres of land to the Ciri- for a University Pazk and Innovation District (LTPID); and WHEREAS; the City is ezpecting to receive much of the land within the next year; and VdHEREAS. staff is workine on se��eral activities that are foundational to the continued plannine and ultimate development of the UPID; and WHEREAS; additional legal assistance �vill be required to implement the UPID; and VdHEREAS, the City has entered into an Etclusive Negotiatine Aereement (EI�'A) �t�ith HomeFed to serve in the role of Master Developer for the UPID; and N'HEREAS, staff has been meeting H�ith representatives from HomeFed weekly and has developed a framework for the transactional and em�ironmental/entitlement w�ork that has been agreed to by both parties to implement the UPID: and ��'HEREAS. due to limited resources and the time that it ���ill tal:e to conduct all of the transactional and em�ironmental/entitlement N�ork to implement the UPID, the Cit�� Attomey`s office requires additional legal resources to ha��e the UPID come to fruition; and V�'HEREAS, as such; the Citv Attorney's office placed ad��ertisements in the San DieQo Daily Transcript and Los An2eles Dail�� Joumai for a Request for Qualifications/Proposal (RFQP) from attome}�s and law firms to submit their qualifications and proposal to assist the Cin� Attornev's Office in implementins the UPID: and V�'HEREAS; the RFQP process resulted in the submission of qualifications/proposals from eleven (11) attomeys/la��� firms from around the state: and �1'HEREAS. the City Attomeds office created an in-house selection committee (the "Selection Committee`), familiar �vith the UPID. to re��ie�v the qualifications/proposals; and Resolution I`'o. 2014-062 Page Z R'HEREAS. the Selection Commiriee reviewed and ranked the proposals based on firm experience, quality of management team, capacity to perform the work, project understanding, proposal quality and clarity, local eaperience, and billing rates; and WHEREAS. after Selection Committee interviews. the Selection Committee rated and chose Stradling, Yocca, Carlson & Rauth, PC for the transactional work and Norton, Moore and Adams, LLP for the environmentaVentitlement work; and WHEREAS, Norton, Moore and Adams, LLP has withdrawn itself from consideration for the em�ironmentaUentitlement work: and WHEREAS; staff has again reviewed the qualifications/proposals and has determined that the Thomas Law Group is also highly qualified to assist the City Attorney's office in review of the subject environmental/entitlement work required for the UPID. NOW, THEREFORE. BE IT RESOLVED by the City Council of the City of Chula Vista, that it hereby approve the Resolution of the City Council of the City of Chula Vista approving a Legal Sen�ices Agreement between the City of Chula Vista and the Thomas Law Group for attorne}� services related to the preparation of land use implementation and en��ironmental documents for the Uni��ersity Park and Innovation District, in the form presented, with such minor modifications as may be required or approved by the City Attomey, a copy of which shall be kept on file in the Office of the City Clerk, and authorize and direct the City Attorney or desi�nee to ezecute the same.
