HomeMy WebLinkAboutOrd 1978-1819 , , . � y� ORDINANCE NO. 1819 AN ORDINANCE OF THE CITY OF CHULA VISTA, AMENDING THE ZONING MAP OR MAPS ESTABLISHING BY SECTION 19 . 18. 010 OF THE CHULA VISTA MUNICIPAL CODE REZONING 10 ACRES LOCATED ON BOTH SIDES OF MELROSE AVENUE, NORTH OF OTAY VALLEY ROAD FROM R-1 TO R-3-P-12 , AND CERTIFYING THE ENVIRONMENTAL IMPACT REPORT WHEREAS, American Building Arts has requested the con- sideration of a rezoning, precise plan and tentative subdivision map for the development of a 116 unit condominium project on about 10 acres located on the north side of Otay Valley Road to the west of I-805 , and WHEREAS, Environmental Impact Report 74-8 was prepared for the development of said property, and WHEREAS, changes in the proposed project and the cir- cumstances under which it is to be carried out has resulted in possible significant environmental effects not discussed in the previous Environmental Impact Report, and WHEREAS, a supplemental Environmental Impact Report, is therefore necessary, and WHEREAS, . the project proponent submitted the necessary technical information for the Environmental Review Section of the Planning Department to prepare said document, and WHEREAS, the draft Environmental Impact Report was issued by the Environmental Review Committee of the City of Chula Vista, giving notice in a newspaper of general circulation, and a Notice of Completion was filed with the Secretary of Resources for the State of California, and WHEREAS, the Planning Commission of the City of Chula Vista held a public hearing on said draft Environmental Impact Report and adopted a final Environmental Impact Report, and WHEREAS, the Planning Commission has heretofore recom- mended that the City Council approve the rezoning of 10 acres located on both sides of Melrose Avenue in accordance with Planning Commission Resolution No. PCZ-78-1. NOW, THEREFORE, the City Council of the City of Chula Vista finds as follows : That EIR-78-11 has been reviewed and the information considered, and that it has been prepared in accordance with the California Environmental Quality Act of 1970 , as amended, the California Administrative Code and the Environmental Review Policy of the City of .Chula Vista. - • The City Council of the City of Chula Vista does ordain as follows : SECTION I ; That the Zoning Map or Maps established by ��Section 19 .18.010 of the Chula Vista Municipal Code be hereby amended by adding thereto the following zoning changes: -1- That that certain property consisting of 10 acres located on both sides of Melrose Avenue, north of Otay Valley Road be, and the same is hereby rezoned from R-1 to R-3-P-12 in accordance with Planning Commission Resolution PCZ-78-I adopted on the 24th day of t4ay, 1978, pursuant to the provisions set forth in Section 19 . 12.020 governing the rezoning of property. SECTION I: That any and all ordinances heretofore adopted by the City Council of the City of Chula Vista concerning zoning of said property be, and the same are hereby rescinded insofar as the provisions therein conflict with this ordinance.
