THE CITY COUNCIL OF THE CITY OF CHULA VISTA DOES ORDAIN AS fOLLOWS: SECTION I . That Sections 15.08.D10, 15.08.020, 15.08.030, 15,08.050, 15.08.060, 15.08.070, 15.08. 120, 15.08.130, 15.08. 150, 15.08. 240, 15.08.270, 15.08.310, 15.08.320, 15.08.370, 15.08.410 are hereby amended to the Chula Vista Municipal Code to read as follows: Section 15.08.010. Adopted by reference. There is hereby adopted by reference the Uniform Building Code, 1976 Edition, and Chapter 13, 35, 49, and 57 of the Appendix that certain document as copyrighted by the International Conference of Building Officials , three copies of �•ihich are on file � in the Office of the City Clerk. Said document is hereby adopted as the Building Code of the City of Chula Vista for regulating the erection, construction , enlargement, alteration, repair, moving, demolition, conversion, occupancy, use, �eigl�t, and area of all buildings and structures in the City. Providing for the issua�ce of permits and collection of fees therefor and each and all such regulations , provisions , penalties , conditions and terms of the Uniform Building Code, 1976 Edition, and Chapters 13, 35, 49, and 57 of the Appendix are hereby referred to, adopted, and made a part hereof as though fully set forth herein, excepting such portions as are hereinafter deleted , modified, or amended. Section 15.08.020. Section 301 (a) of the Uniform Building Code is hereby amended to read as follo�as : Section 301 (a) PERMITS REQUIRED. No person, firm or corporation shall erect, • construct, enlarge, alter, repair, move, improve, remove, convert, or demolish any buildin9 or structure in the City of Chula Vista or cause the same to be done o-iithout first obtaining a separate building permit for each such building or structure from the Building Official except the follo���ing : 1'. Fences and free standing masonry �valls up to 72 inches in height. 2. Curbs , retaining walls and planter boxes up to 18 inches in height. 3. Patio covers up to 100 square feet and at least 6 feet from any other building on the same property. 4. One story tool and storage sheds and other accessory buildings with not mor.e than 100 square feet of projected roof area. 5. Television and radio antennas supported on roofs. 6. Awnings projecting up to 6 feet and attached to the exterior•-walls of buildings of Group R or f4 Occupancy. 7. Standard electrolier not over 35 feet in-height above finish grade. 8. Repairs which involve only the replacement of component parts of existing work with simitar materials for the purpose of maintenance , and which do not aggregate over 5200.00 in valuation in any twelve month period, and _� do ncit�affect any electrical or mechanical installations. Repairs exempt from permit requirements shall not include any addition, change, or .Modification in construction, exit facilities, or permanent fixtures or equipment. Specifically exempted from permit requirements without limit to valuation are: .a. Painting and decorating. � b. Installation of floor covering. c. Cabinet work. d. Outside paving. e. Reroofing buildings of Group R and M Occupancies located within Fire Zone 3. This Section shall not be construed to require separate building permits for a dwelling and auxiliary buildings or structures on the same property which are �escribed in the building permit application, plot plan, and other drawings. Section 15.08.030. Section 204 Amended. Section 204 BOARD OF APPEALS AND ADVISORS. In order to determine the suitability of alternate materials , methods of construction, deviation from dimensional requirenents �•�hen the deviation does not affect the health, safety and �velfare of the occupants and the general public and to provide for reasonable interpretation of the provisions of this Code, there shall be and is hereby created a Board of Appeals and Advisors consisting of seven members who are qualified by experience and training to pass upon matters pertaining to building construction. The Director of Building and Housing shall be an ex-officio member who shall not be entitled to vote and who shall act as Secretary to the Board. The Board of Appeals and Advisors shall be appointed by the Mayor and confirmed by the City Council . The Board shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the Director of Buildin9 and Housing with a duplicate copy to the appellant. The Board of Appeals and Advisors shall recommend to the City Council such new legislation deemed necessary to govern construction in the City of Chula Vista. Section 15.08.050. Section 303 Amended by adding subsection (c) , (d) , (e) , ' �f) , �9)• (c) Expiration of Plan Check. Applications for which no permit is issued and on which no action is taken by the applicant within 240 days folloo-�ing the date of application shall expire by limitation and plans submitted for ciiecking may thereafter be returned to the applicant or destroyed by the Building Official . The Building Official may extend the time for action by the applicant for a period not exceeding 240 days upon written request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken. (d) Com liance Surve Fee. The fee for conducting a compliance survey of an existing structure shall be .50 per 100 square feet or fraction thereof of floor area, but no less than 525.00. (e) Reinspection Fee. The fee for reinspection shall be 510.00. (f) Exceptions. The United States, the State of California, school districts , counties, cities and other public agencies shall not be required to pay any fees for filing an application for a building permit pursuant to this Code. (g) Retention of Plans. Because tne State law requires the retention of plans , specificatior� and permits for the life of the building, the applicant shall be charged a fee to cover the actual cost of microfilming such documents. Section 15.08.060. Section 304 Amended by adding subsection (g) . (g) Compliance Survey Inspection. Upon receipt of a written request for a compliance survey from the owner and payment of the fee specified in Section 303(d) , the Building Official may inspect an existing structure to ascertain its compliance with the provisions of this Code and other applicable laws and ordinances , and report ' his findings in writing to the owner. I z I . . Section 15.08.070. Section 1709(a) Amended. � Section 1709(a) PARAPETS. Parapets shall be provided on all exterior �valls of buildings except as follo�•�s: � 1 . tJalls not required to be of fire resistive construction. 2. l•lalls that terminate at roofs of not less than two-hour fire resistive construction or roofs constructed entirely of noncombustible materials. 3. lJalls where unprotected openings are perraitted. 4. 4lalls on buildings having a floor area of not more tnan 1 ,000 square feet per floor. 5. 4lalls on buildings of Group R or h1 Occupancy not more tnan 25 feet in heiglit and provided with a fire retardant roof covering. 6. Conversion of the existing Group R Occupancy to Group B, Division 2 Occupancy. Section 15:08. 120. Section 1502 Mended, exception added. EXCEPTION: Argriculture and nursery shade structures used only for the protection of live plants and vegetation, when covered with non-combustible or plasticized material which is inherently flame retardant, and whicn is approved for external use, �aay exceed 1 ,000 square feet in area. Section 15.08. 130. Section 1503 Amended. Section 1503 LOCATION OF AGRICULTURE AP�D fdURSERY SHADE STRUCTURES. Agriculture and nursery shade structures used only for the protection of live plants and ve9etation when covered o-�ith non-combustible or plasticized material which is inherently flame retardant and which is approved for external use shall be located only in Fire Zones 2 or 3, znd ;-ihen located in Fire Zone 2,shall be not less than 10 feet frora any adjoining interior lot line if the covered area exceeds 1 ,000 square feet. Section 15.08. 150. Section 3305(1 ) Amended. Section 3305(1 ). EXTERIOR STAIRWAY PROTECTION. All openings in the exterior walls of a building below or ��ithin 10 feet measured horizontally of an exterior exit stairway snall be protected by a self-closing or automatically closing fire assembly having a 3/4-iiour fire resistive rating. EXCEPTION: 1 . Protected openings shall not be required adjacent to stairways in which the distance from the top of the stair��iay to the bottom of the stairway does not exceed 16 feet in vertical projection. EXCEPTIOfJ: 2. Openings may be unprotected �ahen two separate exit stair�aays serve an exterior exit balcony. Section 15.08.240. Section 3802(b) Amended by adding subsection 12. 12. In every building regardless of occupancy, group, or type of construction when such building is more than 40 feet or four stories or more in height. Section 15.08.270. Section 3203(d) Amended by adding subsection 9. 9. Reroofing. The minimum built up reroofing shall be not less than 2 layers of 15;` organic fiber felt applied as required for base sheets and one layer of 90� mineral surface organic fiber felt cap sheets. The base sheets shall be nailed unless the deck is non-nailable. Existing roofing on non-nailable roof deck shall be completely removed prior to tfie application of a new roof. Existing gravel roof shall be scraped off and the roof swept broom-clean. Any existing metal gravel stops shall be stripped clean or replaced except when the reroofing material will be shingles. -3- . . � ' ' . Section 4901 of the Appendix of the Uniform Building Code is amended to read as follo�vs: Section 4901 PATIO COVERS. Patio covers are one story roof structures which shall not exceed 12 feet in height. Patio covers shall be open on one or more sides with minimum soffit height of 6 feet, 8 inches measured from patio floor. Where two sides are open, such open sides may be partially closed by solid materials which are not more than 30 inches in height above patio floor. Patio covers may be detached or attached to otfier buildings as accessories to Group R and M Occupancies. Patio covers shall be used only for recreational , outdoor living purposes not as carports, garages, storage room or habitable rooms. EXCEPTION: l . Open sides may be closed with insect screening and plastic. EXCEPTION: 2. Open sides may be closed with solid material , except an area ' equal to 65� of the long side of the patio. In computing the 65% rule, only the screen and plastic area can be used. The computed area may start no higher than 30 inches from the patio floor. Section 15.08.320. Section 4706(e) Amended. Section 4706(e) . APPLICATION OF METAL PLASTER BASES. The application of metal lath or wire fabric lath shall be as specified in Section 4505(c) and they shall be furred out from vertical supports or backing not less than ; inch, except as set forth in footnote ��o. 2, Table No. 47-B. Where no external corner reinforcement is used, lath shall be furred out and carried around the corner to at least one support on frame construction. A weep screed shall be provided at or below the foundation plate line on all exterior stud walls. The screed shall be placed a minimum of 4 inches above grade and shall be of a type to allow trapped water to drain to the exterior of the building. The weather resistive barrier and exterior lath shall cover and terminate on the attachment flange of the screed. Section 15.OII.370. Section 4407 Amended by adding subsection (e) . (e) At any construction site wherein an excavation of 3 feet 6 inches or more is dug shall be required to be completely fenced around the perimeter site with either a solid v�ooden fence or woven o-�ire fence of not less than 4 feet in height. Said fence shall be equipped with gates that can be locked during such periods as construction is not in progress and that said fence shall be appropriately posted with no trespassing signs , provided however, that said requirements shall not apply to single family and multiple family dwellings of less than three units or to construction sites �•�here said excavation is not in existance for more than a 24-hour period. Section 15.08.410. Section 3601 Amended by adding subsection (e) and (f) . (e) EQUIPMENT ENCLOSURE. Operating equipment including piping and ducts located on the roof of a building shall be completely enclosed so as to be shielded from view and soundproofed so as to comply with the noise abatement provisions of . Sections 19.66.060, 19.66.070 and 19.66.080 of the Municipal Code. (f) OBSOLETE ROOF EQUIPMENT. Mechanical equipment including piping and ducts located on the roof of a building and no longer in operation shall be removed from the roof. SECTION II . That Sections 15.08.040, 15.08.080, 15.08.090, 15.08.100, 15.08.110, 15.08. 140, 15.08. 160, 15.08.170, 15.08. 180, 15.08.190, 15.08.200, 15.08.210, 15.08.220, 15.08.230, 15.08.250, 15.08.260, 15.08.280, 15.08.290, 15.Oa 300, 15.08.330, 15.08.340, 15.08.350, 15.08.360 of Chapter 15.08 are hereby deleted. This Ordinance shall take effect and be in force on the thirty-first day from and after its passage and approval .
