' . . . . �0 Revised• 12-��-76 ORDINANCE NO. 1713 AN ORDZNANCE OF THE CITY OF CHULA VISTA AMENDING ZONING MAP OR MAPS ESTABLISHED BY SECTION 19 .18.010 OF THE CHOLA VISTA MUNICIPAL CODE, REZONIPIG THAT . CERTAIN PROPERTY LOCATED AT 740 DORA LANE FROM R-1-H TO C-O-P, AND CERTIFYING THE ENVIRONP�NTAL IMPACT REPORT WHEREAS, the applicant has requested a change of zone from R-1-H to C-O-P and the approval of a precise plan for approximately 30 acres of the Community Hospital site on Dora Lane, a quarter mile south of Telegraph Canyon Road, and WHEREAS, the proponents of the project involving a medical office building and skilled nursing facility located to the south- west of Community Hospital, wish to receive discretionary approval of said project, and WHEREAS, the Environmental Review Committee of the City of Chula Vista found that the proposed project could have a signifi- cant effect on the environment, and WHEREAS, proponents of said project retained an environ- • mental consultant selected from the list of said consultants approved by the City Council of the City of Chula Vista, and WHEREAS, said consultant submitted an application for an Environmental Impact Report to. the City of Chula Vista, _and WHEREAS, after independent review and analysis of said application, the Environmental Review Committee of the City of Chula Vista issued a' draft Environmental Impact Report on said project • � giving legal notice of the availability of said draft Environmental Impact Report and filing a notice o£ completion with the Secretary of � Resources� of the State of California, and WfiEREAS, said draft Environmental Impact Report was avail- able for public review and scrutiny for a period in excess of 30 days, ' and WIIEREAS, the Planning Commission o£ the City of Chula Vista held a public hearing on said draft Environmental Impact Report and adopted a final Environmental Impact Report, and WHEREAS, the Planning Commission has heretofore recommended that the City Council approve the rezoning of approximately 5 acres of the 30 acre site requested, thus reducing the commercial area as a mitigating measure as indicated in Planning Commission Resolution - No. PCA-76-B. NOSd, THEREFORE, the City Council of the City .of Chula Vista finds as £ollows : That EIR-76-6 has been• revie�aed and the information con- sidered, and that it has been prepared in accordance with CEQA, the California Administrative Code and the Environmental Review Policy of the City of Chula Vista. - 1 - ' ' ' ' Revised 12-3-76 NOW, THEREFORE, the Citx CouncYl does furtlier: f�d as the basis for rezoning from R-1-H to C-O-P as follows: 1. The present use as a' medical facility serves a neces- sary and desirable community function and is a compatible use within the area which the�General Plan indicates will be developed in pre- dominantly low' to medium density residential uses. The proposal to expand� medical uses� on the remainder' of the site has the potential of expanding community health care facilities for the present and future populations , increasing the tax base and creating new jobs. The medical of£ice building will complement current health care functions. of the' hospital and provide� greater convenience for both medical personnel and the public served, The future convalescent hospital will similarly be an inte- grative use for the facilities on the site. It is of utmost impor- tance, due� to� a' number of factors including the visibility of the site, because. of� its relative elevation and the importance of the hospital to' the community, that the high standards of development of the current facility be maintained for the proposed medical office building' and convalescent hospital. • 2. The major purpose in rezoning the site is to allow medical offices to be developed thereon. A concern over the rezonina to C-O-P .is that the office uses allowed in that zone are not limited to medical uses alone. As a result of rezoning, it would not be possible 'to limit' future uses to those which are medically related • and could allow' an incursion of other office uses . If, on the other hand, only the portion of the site proposed specifically for medical offices were rezoned, it would permit that use and leave the remainder of the site in the R-1-H zone. This� zoning would permit the current hospital uses and a future ,convalescent hospital by conditional use permit. This control of the land' for medical uses by the Planning Commission' would be maintained. The City Council of the City of Chula Vista does hereby ordain as follows : SECTION I : That the 2oning Map or Maps established by Section 19. 18. 010 of the Chula Vista Municipal Code be hereby amended by adding thereto the following zoning changes: That that certain property consisting of approximately 5 acres, located at 740 Dora Lane be, and the same is hereby rezoned from R-1-Fi to C-O-P in accordance with Planning Commission Resolu- tion No. PCA-76-B, adopted on the 25th day of October, 1976 , pursuant to the provisions set forth in Section 19 . 12 . 020 governing the re- zoning of property. SECTION II : That any and all ordinances heretofore adopted by the City Council of the City o£ Chula Vista concerning zoning of said property be', and the . same are hereby rescinded insofar as the provisions therein conflict with this ordinance.
